Council Chambe rs, .¢¢lgene,Oregon. · November 2~rd, 1925. <br /> <br /> Minutes of adjourned m~etlng of the Common Council held November 23rd,1925, <br />at 7;30 o~elook P.M. there being present the Mayor and all members of the Coun- <br /> <br /> A.L. Ball appeared as to the condition ~f the sidewalk near hi~ home. Said <br />matter was referred to the ,Ft, reet Cot,amities. <br /> <br /> Parties appeared as to the condition o{ walks at and near ~l~ner'ald and 20th <br />Sts. and also making that a s~treet light be installed at ~erald and 20th !~ts. <br />The sidewalks were referred to the Street Committee and the light to the ~ir.e <br />and Water Con~nlttee. <br /> <br /> Parties also apo~ared and asked that sidewalks be constructed on Ea'.~t 18th <br />AvE. a,iJaet~t to Block 8, Driverton~s Ad:~tlon. S'aid matter was referred to the <br />Street Committee· <br /> <br /> Robert C Merrill present, ed a petition in writing asking that the City accept <br />his garage as built at 1811 ~alrmount Boulevard, which does not quite conform to <br />the City Ordinance. a~chmatter w~S discussed and,on motion, the petition was <br />g r ant ed. <br /> <br /> Erick W Allen presented a letter stating he has ~ettt[one4 for a walk o~ <br />Birch Lane over a year ago a~d no action hs~1 been taken, altho relief was pro- <br />mised. Said matter wa~ referred to the City Engineer. <br /> <br /> Webster L Kincaid petitioned the lle¥ between Park and 9th Ave adjacent to <br />property owned by him be repab'ed as to the cuts therein made by the T~lephone <br />Company. Said matter was referred to the Street ,~>~mlttee and the City Engineer. <br /> <br />Permission to erect aerial were granted as follows: <br /> James Maxwell at 1066 Pearl St. <br /> E H Hataling at 570 15th Ave. E. <br /> Bron H Drake at 411 LincoLn St. <br /> Lester E San£ord at 1838 Lawrence St. <br /> <br /> A letter was read from the State Fire l{arshal as ~.o the contrition of the <br /> ~0 <br />Encore ~{ tel owned by N.P. GayloMd. The matte~: was Refe~r~ed to the Fire ~hief <br />for rePort. <br /> <br /> The Unica Oil Co. presented a contract and asked the city to 6xeeute it for <br />the sale by that company of g~, oil and kerosene for 1926. The I~ee~)Rder was di- <br />rected to call for bids from the Standard and Shell Companies, before any action <br />is taken. <br /> <br /> The Judiciary Committee reported on the claim for damages of W B Mikesell <br />of ~UO.OO and reoor~nend.~i such elalm be allowed. On motion suchreport was adopt <br />ed. <br /> <br /> The matter of there beiug so many globes in ~he City's lighting system in <br />which no lights are burning was discussed and referred to the Fire and Water <br />Corm~itt e e. <br /> <br /> J.O. Withrew appeared and .~tao ed trees at 668 7th Ave. W. are in a dangerous <br />condition. Said matter was referred to the Park ~oard. <br /> <br /> Mr. Ware aPPeared and stated tn 'the grading and paving of Agate Street a <br />ditch under the street had been changed running the flow of water fro~ its naturi <br />channel across his land, and objected thereto. Said matter was referred to the <br />Street Co~itt es. <br /> <br /> The following resolution was offered and on roll call all voted aye, except <br />Willis~son and Pugh who voted no, and HendeRshott not voting. <br /> <br /> ~ ES 0 L U T I 0 N . <br /> <br /> WHFRE~S, he~etofore a certain lease was directed to be executed by the Uity <br />Rec,~rder and the Mayoron behalITM of the City of ~gene to the City of Springfield. <br /> <br /> AND ~'~HEPE&$, owing to the wording of' the clause "eonslstent with the right <br />of the City of Eugene to lease the s~me" in said lease leaves some doubt as to t~ <br />the lease being absolutely and unconditional according to its terms. <br /> <br /> IT IS TIlERS. FORE R~OLV~D, that the Clt¥ of ~igene does hereby direct the <br />Mayor and RecoRder to execute a.n amended lease so worded a8 to exclude the idea <br /> <br /> <br />
