<br />Councilor Clark determined from City Attorney Klein that the motion would apply only to the Crest <br />Drive assessment. City Attorney Klein did not think the motion established a legal precedent for any <br />other assessment project. <br /> <br />Councilor Taylor wished the motion could set a precedent. She said that many of those affected by the <br />project had no jobs or health insurance because of the recession, and she thought the City should take <br />those factors into account. <br /> <br />Councilor Poling determined from Mr. Schoening that the City had already passed ordinances levying the <br />assessments for the Maple-Elmira and Chad Drive projects. Councilor Poling asked if passage of the <br />motion would require the assessment to be calculated. Mr. Schoening said yes. The project would <br />increase in cost because of the additional people who qualified for the subsidy, the additional effort <br />required to amend the resolution, and the cost of borrowing. Councilor Poling recalled that the process <br />was several years old at this point. Mr. Schoening concurred. <br /> <br />Responding to a question from Councilor Zelenka, City Attorney Klein indicated the two parts of the <br />motion were interconnected in that the City Council could not adopt the ordinance until it determined who <br />qualified for the subsidy. He anticipated that it would be two to four months before the council could act <br />on the ordinance.
