manager prior to final surfacing. If an abutting property's access <br />drive is used: <br />a. An access easement- maintenance agreement is required, which <br />shall be recorded in the Lane County office of Deeds and <br />Records, and <br />b. The abutting property shall meet off-street parking <br />requirements for that property. <br />3. If access is provided via an existing unimproved alley, a petition for <br />improvement is required. The alley must be able to provide <br />automobile and emergency vehicle access to a public street. <br />4. whether or not the portion of the flag lot with public street frontage <br />is used for access, it shall remain free of structures and be available <br />for possible future access to a public street. <br />5. Each rear lot or parcel shall have 2 off - street parking spaces located <br />outside of the pole portion of the flag lot. <br />9.2777 Duplex Division Lot Standards <br />(1) Purpose. Duplex division lots allow existing duplexes to be divided into two <br />separate legal lots in order to increase opportunities for affordable home <br />ownership. <br />(2) Land Division Regulations. All applicable regulations for the type of land <br />division process being used must be met except where the duplex division lot <br />standards create different requirements. <br />(a) The existing lot must contain at least 8,000 square feet. <br />(b) The resulting lots will be relatively equal in size with the maximum <br />difference equal to 10 percent or less of the total area of the original lot. <br />(c) The average lot width is at least 40 feet. <br />(d) The minimum lot area is at least 3,600 feet. <br />(3) Use Regulations. Duplex division lots have the same land use regulations as <br />the base zone. <br />(4) Development Standards. <br />(a) All base zone standards must be met unless otherwise stated in this <br />section. <br />(b) The existing lot is occupied by a duplex that conforms to all applicable <br />regulations. <br />(c) A single family dwellling will not replace or be added to the lot. <br />(d) Each parcel will have independent service unless common service is <br />approved by the affected utility agency and is adequately covered by a city <br />attorney approved easement recorded in the Lane County Recorder's office <br />and establishing the rights, responsibilities, and liabilities of the affected <br />parties. <br />(e) Prior to approval, the planning director may require an applicant(s) to <br />enter into a written, city attorney approved agreement suitable for <br />Ordinance - 114 <br />
