9.4650 Industrial Corridor Annexation Agreement <br />(1) Property owner execution of the Annexation and Urban Services Agreement, <br />Exhibit C to the April 25, 1991 Annexation and Urban Services Policy <br />Agreement between the Industrial Corridor Community Organization and the <br />City of Eugene, consenting to annexation to the city of the entire development <br />site will be required for the following: <br />(a) Any land divisions when lots or parcels created will be less than the <br />minimum parcel sizes specified for the lots or parcels prior to the land <br />division. <br />(b) Any zone change or planned unit development approval. <br />(c) Any development permit for a new land use or a reconstruction, <br />conversion, alteration, relocation or expansion of an existing use, if the <br />proposed use will generate, singly or in the aggregate, any additional need <br />for an urban facility or service of a type then supplied to any user by the <br />city. <br />(2) Permits or applications for the following uses are exempt from the requirement <br />to execute an annexation agreement under this section: <br />(a) Sales stands of up to 300 square feet for agricultural products not grown or <br />raised on the premises. <br />(b) One one - family home or 1 manufactured dwelling per lot in conjunction <br />with a farm use or the management, growing, or harvesting of forest <br />products. <br />(c) Home occupations. <br />(3) The Annexation and Urban Services Agreement will be binding upon the <br />property owner's heirs, assigns and successors in interest. A memorandum <br />thereof will be filed by the city in the office of the Lane County Recorder. <br />/WP Waterside Protection Overlay Zone <br />9.4700 PuriDose of [WP Waterside Protection Overla y ,Zone. The purpose of the /WP <br />Waterside Protection overlay zone is to protect water quality in designated waterways, <br />riparian areas, and adjacent wetlands by maintaining an undeveloped setback area <br />between these features and adjacent developed areas. Maintenance of this setback <br />area is also intended to protect wildlife habitat and prevent property damage from <br />storms and floods. The /WP overlay zone is intended to maintain or enhance open <br />space areas adjacent to water features. These open space areas are important because <br />they typically contain native vegetation; convey, store, or improve the quality of urban <br />stormwater runoff; provide habitat for wildlife; and, where appropriate, can provide <br />legally obtained access for channel maintenance. Uses and activities permitted in <br />these areas are restricted in most cases to those that are consistent with the purpose of <br />this overlay zone.
