letter, or failure to provide statements or evidence with sufficient <br />specificity to enable the decision maker to respond to the issue, precludes <br />an appeal based on that issue. <br />(i) The name and telephone number of a city contact person. <br />�) A brief summary of the local decision making process for the decision <br />being made. <br />9.7670 Investigation and Report. At least 7 days pri or to the public hearing, the staff <br />report, if any, shall be submitted to the planning conunission and made available to <br />the public upon request. A copy of the report shall be mailed or delivered to the <br />applicant at the time it is delivered to the planning commission. <br />9.7675 Public Hearin Conduct and Procedures. The planning commission shall conduct <br />a public hearing according to quasi - judicial procedures in State law and as set forth in <br />EC 9.7065 through 9.7095, Quasi-Judicial Hearings- Procedures. <br />9.7680 Decision Unless the applicant and appellant agree to a longer time period, the <br />planning commission shall make a decision within 15 days of the close of the record. <br />The planning commission shall affirm, reverse, or modify any decision, <br />determination, or requirement of the hearings official or historic review board. In <br />addition, upon concurrence of the applicant, including waiver of the right to a <br />decision within 120 days, and with the payment of an additional fee, the decision can <br />l be remanded to the original decision- maker. Before reversing the decision, or before <br />changing any of the conditions of the hearings official or historic review board, the <br />planning commission shall make findings of fact as to why the hearings official or the <br />historic review board failed to properly evaluate the application or make a decision <br />consistent with applicable criteria. The action must be agreed to by a majority of the <br />members present at the hearing. A tie vote results in affirming the decision of the <br />hearings official or the historic review board. The planning commission's action is <br />final. <br />9.7655 Notice of Decision <br />(1) Within 5 days after the planning commission's decision is rendered written <br />notice of the decision shall be mailed to all of the following: <br />(a) Applicant. <br />(b) Owner of the subject property. <br />(c) Appellant. <br />(d) Any person who provided oral or written testimony in a timely manner <br />during the hearing procedures. <br />(e) Any person who requested notice of the appeal decision. <br />(2) The notice shall: <br />(a) Summarize the decision of the planning commission. <br />(b) Explain the appeal rights. <br />Ordinance - 311 <br />
