conditional use permit may be considered in accordance with the Type II application <br />procedures contained in EC 9.7200 through 9.7230, Application Procedures. The <br />planning director shall approve or deny the modification request. The planning <br />director shall approve a request if the proposed modification is not materially <br />inconsistent with the conditions of the original approval and will result in <br />insignificant changes in the physical appearance of the development, the use of the <br />site, and impact on the surrounding properties. If the requested modification does not <br />meet the criteria for approval, the application will be denied. The applicant may <br />submit the requested modification as a new conditional use permit application based <br />on Type III procedural requirements. Nothing in this land use code shall preclude the <br />applicant from initially submitting the requested modification as a new conditional <br />use permit application. <br />9.5113 Conditional Use Permit Revocation The hearings official may revoke a <br />conditional use permit based on the criteria in EC 9.0260 Revocation of Conditional <br />Use Permits in the manner provided in that section. <br />Hazardous Materials Review <br />9.8130 Purpose of Hazardous Materials Review The purpose of Hazardous Materials <br />Review is to ensure that a development or use proposed to be located in an area with <br />either known or potential special hazardous materials is established only if necessary <br />steps have been taken to address issues of public health, safety and welfare. <br />9.5135 Applicability Hazardous material review is required when the development or use is <br />proposed to be located in an area with either known or potential special hazardous <br />materials, as defined in this code or rules issued thereunder, based on the prior use of <br />the site or the existence of hazardous materials located on or adjacent to the site. <br />9.8140 General Application Requirements An application for Hazardous Materials <br />Review shall contain each of the items required by the American Society for Testing <br />and Materials (ASTM) Standards E -1527 and E -1525, available at the city's public <br />works department. <br />9.5145 Approval Criteria The planning director shall approve, conditionally approve, or <br />deny an application for Hazardous Materials Review, following 'a Type II process. <br />Approval or conditional approval shall be based on compliance with the following <br />criteria: <br />(1) The proposed development or use will have no adverse health or safety impacts <br />on the community. <br />(2) The proposed development or use will meet adopted city standards related to <br />hazardous materials. <br />Ordinance - 343 <br />
