9.8825 Modifications to a Willamette Greenwav Permit. After the effective date of <br />approval of final plans, modifications to the approved final plans may be considered <br />in accordance with the Type II Application Procedures contained in EC 9.7000 <br />Application Procedures. The planning director shall decide whether to grant the <br />requested modification based on the following criteria: <br />(1) The modification will be consistent with the conditions of the original approval; <br />and <br />(2) The modification will result in insignificant changes in the physical appearance <br />of the development, the use of the site, and impact on the surrounding <br />properties. <br />If determined to be consistent with the above criteria, the planning director shall <br />approve the request. The applicant retains the ability to submit the requested <br />modification as a new Willamette Greenway permit application based on the Type III <br />procedural requirements. Nothing in this land use code shall preclude the applicant <br />from initially submitting the requested modification as a new Willamette Greenway <br />permit application. <br />Zone Change <br />9.8850 Purpose of zone Chan As the Metro Plan is implemented over the years, there <br />will be a need for changes in zoning. As that plan is reviewed and periodically <br />revised, other zone changes may be warranted. <br />9.8855 Applicability Changes in zoning, including the application of or change of an <br />overlay zone or special area zone shall be processed as a Type III application as <br />provided in EC 9.7300 through. EC 9.7340 Type III Application Procedures with the <br />following exceptions: <br />(1) The proposed zone change would apply the /ND Nodal Development Overlay <br />Zone, in which case the zone change shall be processed as a Type IV application <br />as provided in EC 9.7400 through 9.7475. See EC 9.4260. <br />(Z) The proposed zone change involves an annexation request that qualifies for an <br />automatic change in zoning, as provided in EC 9.7510 Chan es in zoning <br />(3) The proposed zone change involves a concurrent amendment to the Metro Plan <br />or a refinement plan, or the adoption of a new refinement plan; in which case <br />the zone change shall be processed as a Type IV or Type V application as <br />provided in EC 9.7400 through EC 9.7475 Type IV Application Procedures and <br />EC 9.7504 through 9.7560 Type V AMlication Procedures <br />(4) The proposed zone change is processed concurrently with an amendment to this <br />land use code; in which case, the zone change shall be processed as a Type V <br />application as provided for in EC 9.7500 through EC 9.7570 Type V <br />Application Procedures <br />Ordinance - 3 8 5 <br />
