The schools serving this site are currently not at capacity, thus, <br />adequate capacity exists and this service will be provided in an orderly and efficient manner and <br />the future maximum allowable intensity/ density of development will not exceed public schools <br />capacity. <br />EC 9.8865(4) The proposed zone change is consistent with the applicable siting requirements <br />set out for the specific zone in: (f) EC 9.2735 Residential Zone siting requirements. <br />Res on <br />This requirement is only applicable for R -1.5 zoning and does not affect the proposed zone <br />change. <br />EC 9.8865(5) In cases where the NR zone is applied based on EC 9.. 510(3), the property <br />owner shall enter into a contractual arrangement with the city to ensure the area is <br />maintained as a natural resource area for a minimum of 50 years. <br />Response: <br />The NR zone is not applied to this parcel. Therefore, the above criterion is not applicable. <br />TRANSPORTATION PLANNING RULE (GOAL 12, TPR) <br />Response: <br />Statewide Planning Goal 12 is implemented through the Transportation Planning Rule (TPR), as <br />defined in. Oregon Administrative Rule OAR 660 -012 -000, et seq. The Eugene - Springfield <br />Metropolitan Transportation Plan (TransPlan) provides the regional policy framework through <br />which the TPR. is implemented at the local level. The TPR requires a determination of which <br />existing and planned transportation facilities will be "significantly affected" as a result of the <br />proposed arraen.dment, and defines what constitutes a significant effect. An amendment will <br />significantly affect an existing or planned transportation facility if, at the end of the planning <br />period, the amendment will reduce the performance of the transportation facility below the <br />minimum acceptable performance standard or will worsen the acceptable performance standard <br />(OAR 660 - 012- 0060(1)(c)(B) and (C}). In determining whether there is a significant effect, <br />Level of Service D (LOS D) is considered the minimum acceptable performance standard for the <br />City of Eugene facilities. The Hearings official in the zone change decision for Mahn, et al (City <br />of Eugene file Z -05 -9) concluded that the City of Eugene zoning reap changes are not <br />categorically excluded from the TPR (OAR 660 -012- 0060). <br />The "end of planning period ", for purposes of the TPR analysis concerning local facilities, is the <br />horizon year identified in the adopted transportation system plan. (TransPlan). That year is 2015. <br />In the current case, the impact of the proposed rezoning on transportation facilities would be <br />insignificant. The subject parcel consists of 0.44 acres. The site and house are designated a City <br />of Eugene Historic Landmark (designated December 9, 2010).
