ADMINISTRATIVE ORDER NO. 58-03~23 <br /> of the <br /> City Manager <br /> City of Eugene, Oregon <br /> <br /> GRANTING AUTHORITY TO THE CITY ENGINEER, TO EXECUTE <br /> AMENDMENTS TO LOCAL SPONSORS COST SHARING AGREEMENT <br /> FOR THE EUGENE-SPRINGFIELD METROPOLITAN WATERWAYS <br /> FEASIBILITY STUDY. <br /> <br /> The City Manager of the City of Eugene finds that: <br /> <br /> A. Under Section 16(2) of the Eugene Charter of 2002~ the City Manager is given <br />attthority to propose the budget, make all purchases and act as a business agent for the City Council <br />in connection with the sale of real estate and other business and commercial transactions. <br /> <br /> B. Pursuant to that authority I have executed on behalf of the City of Eugene an <br />Agreement (the "Agreement," City of Eugene Contract No. 2004-00217) between the Department <br />of the Army, the City of Eugene, the City of Springfield, and Lane County for the Eugene- <br />Springfield, Oregon Metropolitan Waterways General Investigation Feasibility Study (the "Study") <br />with an effective date of September 30, 2003. <br /> <br /> C. An agreement concermng the manner in which the obligations and responsibihties <br />of the local sponsors of the Agreement (Lane County and the cities of Eugene and Springfield) will <br />be assigned is set forth in an Intergovernmental Agreement (City of Eugene Contract No. 2004- <br />00218) (the "IGA") which I have executed on behalf of the City of Eugene. <br /> <br /> D. The IGA provides the parties will annually enter into written budget agreements/'or <br />the Study, assigning the individual responsibilities of each party to furnish services or funding fbr <br />the local govermr~ent sponsors of the Agreement during the ensuing federal fiscal year, for each year <br />that the Agreement remains in effect, and that any mid-year amendments that affect project costs will <br />be made under written change orders. The City's obligations under the Agreement are being <br />performed by its Public Works Department, and it would be more efficient to authorize the City <br />Engineer to execute the annual Budget Amendments to the IGA on behalf of the City of Eugene. <br /> <br /> Now, Therefore, <br /> <br /> The City Manager of the City of Eugene orders and directs that: <br /> <br /> 1.
