Use of City Equipment APPM Section 4.16 (Revised 07126107) <br />City equipment, facilities, supplies, and other property are to be used only for City business and must not be used <br />for personal use either during or outside regular working hours. Exceptions to this policy are noted in the APPM. <br />This policy mandates ethical employee use of office equipment and technology. It encourages use that enhances <br />employee productivity, confirms that electronic communications used in the conduct of government are generally <br />considered public records, and prohibits inappropriate use. <br />Please review this policy carefully prior to using any equipment (including phones or computers) to ensure you <br />understand what is acceptable and what is prohibited. The City reserves the right to search or inspect City <br />equipment or facilities, such as desks, files, lockers, or offices from time to time for work - related or administrative <br />purposes. Abuse or misuse of City equipment, facilities, supplies, or other property will be grounds for disciplinary <br />action. <br />City Vehicles APPM Section 13.4.2 <br />The use of a motor vehicle is a part of many City operations. The City's self- insured automobile liability coverage <br />applies only when City vehicles are used with permission, and in the course and scope of your duties. This means <br />the use of City vehicles for private benefit will subject you to full personal liability in the event of any type of <br />accident. Family members or friends may not be transported in City vehicles. Drivers of City vehicles are required <br />to obey all traffic laws, including the requirement to wear seat belts. <br />All City employees who are required to operate a vehicle are expected to maintain a good driving record. All <br />employees who operate City vehicles will be entered into the State of Oregon Auto Flag System. The Auto Flag <br />System generates a report anytime there is an action taken on a license that is entered into the system. The Auto <br />Flag System is intended to make certain that employees who operate City vehicles have a valid and correct <br />classification of license for the vehicle they operate. <br />If you operate City vehicles and have a change in your operator's license status, you must report that change to <br />your supervisor immediately. If you lose your license or have the incorrect classification of license, your supervisor <br />will not allow you to operate City vehicles. In the event this is a brief, temporary situation, you may be <br />accommodated within your present job or be temporarily reassigned. If the situation is long -term or repeated, and <br />you are required to drive the City vehicle as a part of your required duties, you will be removed from the position. <br />This could result in a transfer, demotion, or termination. <br />Software Piracy APPM Section 5.5.1 <br />It is illegal to use a copy of software outside of the conditions specified in the license. Most purchased PC software <br />is licensed to one person and one PC only. Some software is installed on a Local Area Network (LAN), in which <br />case the license specifies the number of concurrent users. Check the software license to be sure. City owned <br />software shall not be duplicated except where allowed by special agreement with the software publisher. <br />For further information, refer to the General Policies and Procedures Manual (Section 5C -4). <br />Information Produced or Received in the Course of Work APPM Section 4.18 <br />All e-mail messages, voice mail messages, faxes, interdepartmental mail, computer files, and information printed <br />from City computers are all considered property of the City, and may be subject to disclosure under Oregon's <br />Public Records Law (ORS 192.410 to 192.505). Inappropriate or offensive messages such as those including racial <br />or sexual slurs are prohibited. <br />Patents I Copyrights APPM Section 4.1 <br />The City encourages its employees to develop new ideas and to patent such ideas. The City recognizes the right <br />of employees to individually apply for patents and copyrights and to market products for which they have individual <br />responsibility and ownership. However, the City owns all proprietary rights in an invention, design, or work <br />developed by City employees on or off duty using City resources. <br />These rights are further defined by an "Agreement on Patents and Copyrights" which will be signed by each new <br />employee as part of their offer letter upon hiring and by any existing employee upon the request of the City. <br />An employee must disclose to the City any work, design, or invention developed by using City resources. <br />Employees shall cooperate with the City in the obtaining of any patent or copyright. Employees must assign to the <br />City all ownership rights in any invention, design, or work developed by City employees on or off duty using City <br />resources. <br />If the City decides not to pursue or use a patent or copyright, it will assign to the employee, rights to pursue, use, <br />and market the patent or copyright. The City may retain licenses in the invention or publication in the event of an <br />assignment. <br />
