1. CDL DRUG & ALCOHOL POLICY OVERVIEW <br />The City of Eugene is committed to providing and maintaining a safe and healthy work <br />environment for its employees, along with safe and dependable transportation for the public. <br />The use of drugs and/or alcohol can adversely affect the ability to perform safely and may <br />constitute a threat to the health and safety of the public, City employees, and the efficient <br />operation of the City of Eugene. Therefore, the City of Eugene shall establish a work <br />environment where its employees are free from the effects of drugs and/or alcohol. <br />It is the intent of this policy to ensure our employees who drive and/or perform safety - sensitive <br />functions remain drug and alcohol free in the interest of the health and safety of employees and <br />the public, to enhance worker productivity and safety, and to encourage employees to seek <br />assistance and treatment for drug and/or alcohol related problems before such problems affect <br />performance and/or safety. <br />This policy is also intended to comply with all applicable Federal regulations governing drug and <br />alcohol testing. The Federal Motor Carrier Safety Administration (FMCSA) has promulgated <br />rules governing alcohol and drug testing of employees performing safety - sensitive functions (49 <br />CFR, Part 382.103). <br />The objectives of this policy are to: <br />• Maintain a safe, drug- and alcohol -free work environment; <br />• Maintain safe, efficient working conditions for City of Eugene employees; <br />• Maintain the City's compliance with applicable Federal regulations; <br />• Encourage City employees to seek help with problems related to drugs and alcohol. <br />1.2 Application <br />The Federal Motor Carrier Safety Administration (FMCSA) drug testing rules were amended to <br />include drivers who hold a Commercial Driver's License (CDL), regardless of whether the driver <br />operates interstate or intrastate. <br />Amended drug testing rules and new alcohol testing rules became effective January 1, 1995, with <br />subsequent amendments on August 31, 2009; therefore, this policy applies to all employees <br />covered under the FMCSA regulations. Covered employees shall include applicants for <br />employment in positions that require the performance of an FMCSA safety - sensitive function. <br />Participation in the City of Eugene's FMCSA Drug and Alcohol program is a requirement, for <br />employees whose positions include or require possession of a valid CDL, and, thus, is a <br />condition of employment. <br />City of Eugene Page 1 -1 DOT/FMCSA Drug & Alcohol Policy <br />September 2010 Information Packet <br />
