ADMINISTRATIVE ORDER NO. 31-03-03-F <br /> of the <br /> City Manager of the City of Eugene <br /> <br /> ADOPTION OF A FEE FOR APPEAL OF DETERMINATION THAT <br /> PROPERTY NOT FIT FOR USE UNDER ORS 453.876. <br /> <br /> The City Manager of the City of Eugene finds as follows: <br /> <br /> A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager of the City of <br />Eugene to determine and set fees and charges to be imposed by the City for services, goods, use of <br />municipal property, and licenses and permits. Section 2.021of that Code authorizes that appeals <br />shall be accompanied by a fee. <br /> <br /> B. In accordance with the procedures set forth therein, on May 22~ 2003, I issued <br />Administrative Order No. 31-03-03 and notified the Mayor and City Councilors that I intended to <br />establish a fee for appeals of a determination that property is not fit for use under ORS 453.876, as <br />set forth in the Notice of Intended Adoption of a Fee attached thereto as Exhibit A. <br /> <br /> C. Notice was also posted at two locations at City Hall on May 23, 2003, and made <br />available for inspection by interested persons at the offices of the Chief of Police, 777 Pearl Street, <br />Eugene, Oregon, 97401, during normal business hours (8:00 a.m. to 5:00 p.m., Monday through <br />Friday, exclusive of holidays). No written comments were received within the time or in the manner <br />provided in the Notice. <br /> <br /> D. I find that the fee for appeals of a determination that property is not fit for use under <br />OS 453.876 is consistent with applicable policies and directives of the City Council to recover the <br />cost of services from the direct beneficiaxies of those services; is comparable to the fee established <br />in other jurisdictions for similar services; and is necessary in the order to defray the City's costs <br />associated with providing those services.
