RD. 2253) AND <br />FAIRGROUNDS WEST ENTRANCE ROAD (CO. RD. 2267), <br />LOCATED IN THE NORTHWEST ONE QUARTER OF THE <br />SOUTHWEST ONE QUARTER (NW1/4SW1/4) AND <br />SOUTHWEST ONE QUARTER OF THE SOUTHWEST ONE <br />QUARTER (SW1/4SWI/4) OF SECTION 31, TOWNSHIP 17 <br />SOUTH, RANGE 3 WEST AND THE NORTHEAST ONE <br />QUARTER OF THE SOUTHEAST ONE QUARTER <br />(NE11/4SE11/4) OF SECTION 36, TOWNSHIP 1 T SOUTH, <br />RANGE 4 WEST OF THE WILLAMETTE MERIDIAN, IN LANE <br />COUNTY, OREGON, WITH A PUBLIC HEARING AND <br />ADOPTING FINDINGS OF FACT (17-03-31-32,17-03-31-33 & <br />17- 44 -36-41) <br />FINDINGS OF FACT <br />The Surveyor's Office of the Department of Public Works has received a request by Lane <br />County Management Services Facilities Administration to initiate proceedings for the vacation of <br />portions of Fairgrounds Entrance Road (Co. Rd. 2253) and Fairgrounds Nest Entrance Road <br />(Po.. Rd. 2257). The portions of these roads proposed for vacation are located entirely within <br />the Lane County Fairgrounds property. The purpose of this vacation is to facilitate more <br />strategic gate locations and to more effectively address traffic and pedestrian flow, security and <br />safety issues within the Fairgrounds property and in so doing will be in the public interest. <br />Findings of Fact (Public Interest) <br />The Board takes notice and finds: <br />1. That, pursuant to ORS 355.325 to 355.355, a county governing body may vacate roads or <br />easements based upon the determination. that the vacation is "in the public interest." <br />2., - That, pursuant to ORS 1,97.175' (2) (d), after .acknowledgment. of a county's <br />comprehensive plan and implementing ordinances, the. plan and ordinances, not the <br />Statewide Planning Goals, control land use decisions. <br />3 That, Lane County's Rural Comprehensive Plan and implementing ordinances were <br />originally acknowledged to be in compliance with the Statewide Planning Goals on <br />September 13, 1984, and reacknowledged on February 14, 1992. <br />4. That, neither the Lane County comprehensive Plan, nor any land use regulation within the <br />Lane Code, establish mandatory standards for the vacation of public easements. <br />Conclusion of Law (Public Interest) <br />Based. upon the above .findings of fact, the Board concludes, as a matter of law, that <br />neither the Statewide Planning Goals nor the Lane County Rural comprehensive Plan and <br />Vacation,- Findings of Fact - Page 1 of 3 <br />Portions of Fairgrounds Entrance Roads (Co.
