Variances from Area, H eight Limit of Buildings, or Yard Requirements op The Board of Appeals and Adjustments of the City of Eugene is _ hereby appointed to hear all applications for variances from regula -- , tions covering area, height limit of buildings, or yard requirements. The Board of Appeals may authorize said variances if, from the petie" _ ..• tion, or the facts presented at a public hearing conducted by the .�- f Board of Appeals, or from the . investigation, said Board of Appeals finds .. �. a. That the variance requested is not in conflict with the - . ., .gene ral purpose and intent of this ordinance, b. That the variance will not be detrimental to the public weld" - fare or convenience .. c. That such variance is necessary for, the preservation and enjoyment of a -• property right of the petitioner, and to prevent unreasonable property loss or unnecessary hardship, ' and will not : be detrimental nor injurious to the property -or improvements . of other owners of property. r D. FARING 1. Hearing before Common Council Upon the filing of a verified application for variance use,tYie • _ .,Common Council shall set a time for hearing the same, and shall give • . a, reasonable public notice of the time and place of , s aid hearing. - E . iNTERPRETAT,ION'OF. - -. It shall be the duty of appropriate administrative officers of the City to interpret the provisions of this Ordinance covering such. variances so that the spirit of the ordinance shall be observed, public interest protected, and substantial justice done, SECTION XX 4 RIGHT OF APPEAL - Property omers, or interested persons, may, appeal a decision of . the Building Inspector to the City Manager within thirty days.. - Matt e r s referred to the Board of Appeals and Adjustments fo r varima - ances may be further appealed to the Common Council. of the City of Eugene, and said Common Council of the City of Eugene shall have the right and power to grant variances from any of the provisions of this . ordinance .
