<br />detail in the attached findings, this proposal will help achieve the mixed-use vision for this area. Given <br />the physical constraints noted and on-going growth management discussions, the property owner has <br />decided that the time is right to move the existing industrial use and re-develop the site into a mixed-use <br />center. <br /> <br />The Planning Commission held a public hearing on the applicant’s request December 13, 2011. The <br />applicant, Rusty Rexius, and his representative, Larry Reed, provided background information and <br />testified in favor of the proposal. Teresa Bishow, on behalf of Arlie & Co., testified regarding access to <br />their property adjacent to the Rexius site to the north, and Yvonne Barthe, a neighbor to the south, raised <br />questions on how the development would impact traffic near her home. <br /> <br />Following the public hearing, the Planning Commission closed the record, deliberated on the proposal, <br />and voted unanimously to recommend approval. In summary, the Planning Commission agreed with <br />staff’s recommendation that: <br /> <br /> <br /> <br />The loss of this industrial land will not negatively impact economic goals for the area as required <br />under Statewide Planning Goal 9. <br /> <br /> <br />The proposed mix of residential and commercial uses is supported by the policies in the Metro <br />Plan and approval would provide a community-wide benefit by enabling mixed-use <br />development. <br /> <br /> <br />The applicant’s proposal to add the Planned Unit Development (/PD) zoning overlay will result <br />in comprehensive review of future development to ensure compatibility with the surroundings <br />and the provision of necessary transportation infrastructure. <br /> <br />Findings in support of the Planning Commission’s recommendation for approval are included as Exhibit <br /> <br />C to the ordinance (see Attachment C). The ordinance and findings, with any directed changes, will be <br />utilized in the event that the City Council votes to approve the proposal upon finding that it complies <br />with the applicable approval criteria. <br /> <br />A complete set of record materials have also been provided to the City Council under separate cover, <br /> <br />and are available for review in a binder located at the City Council Office. <br /> <br /> <br />HEARING PROCEDURES <br />The public hearing on this request must follow quasi-judicial procedures, and no new evidence will be <br />allowed at the public hearing. <br /> <br /> <br />RELATED CITY POLICIES <br />Eugene Code (EC) requires that the proposal be consistent with the approval criteria at EC 9.7730(3) <br />and EC 9.8865. Consistency with these approval criteria, including applicable Metro Plan policies and <br />Statewide Planning Goals, are addressed in the attached findings (see Exhibit C of Attachment C). <br /> <br /> <br />COUNCIL OPTIONS <br /> <br />No action is required at this time; however, options will be provided at the time of City Council <br />deliberations and action scheduled for March 12, 2012. <br /> <br /> S:\CMO\2012 Council Agendas\M120221\S1202212.doc <br /> <br />
