<br /> <br />ATTACHMENT B <br />Summary of Draft Social Host Ordinance <br /> <br />This proposal would establish criminal and civil penalties for both the person hosting or responsible for <br />an unruly gathering defined in Section 4.670, and the legal property owner. In order to be deemed <br />an unruly gathering, two or more disruptive behaviors must occur on the property, or adjoining the <br />property where a gathering occurs, defined in Section 4.670, and include violations to state and local <br />liquor laws, assault, disorderly conduct, loud noise, public urination, and other offenses, frequently <br />cited as problem behaviors in complaints about unruly gatherings. <br /> <br /> As recommended in the literature search for best-practices, there are graduated penalties that affect <br />both the host and the property owner, depending on the number of citations in the preceding 12 <br />month period from the date of the citation. <br /> <br /> <br />1.For a first violation a person receives <br /> <br />a.the person responsible for hosting or organizing the unruly gathering will be issued a <br />$500 citation, and <br /> <br />b.the property owner will be notified of the citation. <br /> <br />2.For the second violation a person receives at the same address <br /> <br />a.the person responsible for hosting or organizing an unruly gathering will be issued a $750 <br />citation; <br /> <br />b.the person responsible for hosting or organizing an unruly gathering will receive a civil <br />penalty to cover the response costs, which are defined in section 4.670; and <br /> <br />c.the property owner will be notified of the second citation. <br /> <br />3.For the third violation a person receives at the same address, <br /> <br />a.the person responsible for hosting or organizing an unruly gathering will be issued a <br />$1000 citation <br /> <br />b.the person responsible for hosting or organizing an unruly gathering will receive a civil <br />penalty to cover the response costs, which are defined in section 4.670; and <br /> <br />c.the property owner will be notified of the third citation. <br /> <br />4.For the fourth and subsequent violations a person receives at the same address, <br /> <br />a.the person responsible for hosting or organizing an unruly gathering will be issued a <br />$1000 citation <br /> <br />b.the person responsible for hosting or organizing an unruly gathering will receive a civil <br />penalty to cover the response costs, which are defined in section 4.670; and <br /> <br />c.the legal property owner will receive a civil penalty to cover the response costs, which <br />are defined in section 4.670. <br /> <br /> Please note that the graduated penalties follow both the property owner and the person responsible <br />for hosting the party. This is to address problems with the current legislation, and to improve <br />livability for the neighbors, by eliminating loop holes that unintentionally allowed for repeat <br />disruptions. In this draft, if a person who’s received a citation moves to another address and receives <br />a subsequent citation, the cumulative total number of citations is considered in the preceding 12 <br />months, regardless of the site address. Likewise, if a property owner receives a notice that a social <br />host citation has been issued at the property, and there is another citation, the total number of <br />citations at that address is considered in the preceding 12 months, regardless of the responsible <br />person hosting the party. <br /> S:\CMO\2012 Council Agendas\M120423\S120423B-attB.doc <br /> <br />
