ADMINISTRATIVE ORDER NO. 57-12-05 <br />of the City Manager <br />DELEGATING TO THE EXECUTIVE DIRECTOR OF THE LIBRARY, <br />RECREATION & CULTURAL SERVICES DEPARTMENT AUTHORITY <br />UNDER SECTION 3.810 OF THE EUGENE CODE, 1971, REGARDING <br />PATRON USER FEE (PUF). <br />The City Manager of the City of Eugene finds that: <br />A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002, <br />the City Manager is designated as the administrative head of the City, and is specifically <br />authorized to appoint and remove all employees (except as otherwise provided in the Charter), <br />and to enforce all ordinances of the City. <br />B. Section 3.810 of the Eugene Code, 1971, provides that a patron user fee (PUF) be <br />assessed to each attendee of a ticketed event at the Hult Center for the Performing Arts and the <br />Cuthbert Amphitheater. Subsections (3)(c) and (3)(d) of Section 3.810 the Eugene Code, 1971, <br />provide that admission established by the City Manager or designee to be complimentary <br />admission, and events determined by the City Manager or designee to be resident company youth <br />educational events, are exempt from the PUF. <br />C. I find that it would be more efficient and in the public interest to delegate to the <br />Executive Director of the Library, Recreation & Cultural Services Department my authority <br />under subsections (3)(c) and (3)(d) of Section 3.810 of the Eugene Code, 1971. <br />NOW, THERFORE, <br />The City Manager of the City of Eugene Orders and Directs that: <br />1. The Executive Director of the Library, Recreation & Cultural Services <br />Department of the City of Eugene is granted the authority to act as my designee under <br />subsections (3)(c) and (3)(d) of Section 3.810 of the Eugene Code, 1971. <br />2. The delegation of authority contained in this Order shall be construed to extend to <br />and include any person(s) "acting in capacity" (AIC) for the Executive Director of the Library, <br />Recreation & Cultural Services Department. <br />Dated and effective this Z' day of T�� , 2012. <br />r <br />Jon R.
