ADMINISTRATIVE ORDER NO. 56-04-01~F
of the
City Manager of the City of Eugene

DISCONTINtJATION OF FALSE ALARM RESPONSE FEES IN THE
EUGENE POLICE DEPARTMENT FEE SCHEDULE ESTABLISHED BY
ADMINISTRATIVE ORDER NO. 56-01-02-F.

The City Manager of the City of Eugene finds as follows:

A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to determine
and set fees and charges to be imposed by the City for services, goods, use of rcmnicipal property,
and licenses and permits.

B. In accordance with t he procedures s et forth therein, on July 21, 2 004, I issued
Administrative Order No. 56-04-01 and notified the Mayor and City Councilors that I intended to
discontinue the false alarm response fees in the Eugene Police Department Fee Schedule established
by Administrative Order No. 56-01-02-F on January 15, 2002, as set forth in the Notice of Intended
Amendment of Fees attached thereto as Exhibit A. The amendment is necessary because false alarm
response fees are no longer applicable due to recent amendments to the Eugene Code, 1971.

C. Notice was also posted at two locations at City Hall on July 22, 2004, and made
available for inspection by interested persons at the office of the Eugene Police Department, 777
Pearl Street, Eugene, Oregon, 97401, during normal business hours (8:00 a.m. to 5:00 p.m., Monday
through Friday, e xclusive of holidays). T he N otice provided t hat w ritten comments would b e
received for a period of 15 days from the date of posting. No written comments were received
within the time or in the manner provided in the Notice.

D, Based upon the above findings and the findings in Administrative Order No. 56-04-
01, ~ find that the Eugene Police Department Fee Schedule should be amended as proposed.

On the basis of these findings, I order that:

The fees in the Eugene Pohce Department Fee Schedule for "False alarm response
fee" ($70); "Penalty~' (5% of total due), and "Appeal from imposition of costs" ($100) are
discontinued as of the effective date of this Order.

2. The City Recorder shall append a copy of this Administrative Order to Administrative
Order No. 56~01-02-F.

Dennis M. Taylor
City Managers
