<br /> <br />ECC <br />UGENE ITY OUNCIL <br />AIS <br />GENDA TEM UMMARY <br /> <br /> <br /> <br /> <br />Adoption of Resolution 5083 Annexing Land to the City of Eugene <br />(River Ridge Golf Complex - A 12-6) <br /> <br /> <br />Meeting Date: April 8, 2013 Agenda Item Number: 3D <br />Department: Planning and Development Staff Contact: Becky Taylor <br />www.eugene-or.gov Contact Telephone Number: 541-682-5437 <br /> <br /> <br /> <br />ISSUE STATEMENT <br />This item is a request to annex 109.9 acres of property located on the north side of Ayres Road and <br />on each side (east and west) of North Delta Highway. The applicant also proposes annexation of <br />the intervening portion of North Delta Highway, involving 1.52 acres of right-of-way. The subject <br />property contains three dwellings, on the east side of North Delta Highway, but is primarily <br />developed as the River Ridge Golf Complex. <br /> <br />The current zoning of the subject property is also split by North Delta Highway. The portion of the <br />property located on the east side of North Delta Highway is currently zoned AG/UL Agricultural <br />with Urbanizable Land Overlay. Upon annexation, the /UL portion of the zoning will be removed. <br />The AG base zone will remain until a zone change application is processed for consistency with the <br />plan designations of low- and medium-density residential. The portion of the property located on <br />the west side of North Delta Highway is zoned R-1/SR/UL Low-Density Residential with Site <br />Review and Urbanizable Land overlays. The /UL overlay will be removed upon annexation, but the <br />R-1/SR zoning will remain. The /SR overlay indicates that future development of the property will <br />require Site Review approval. <br /> <br />A portion of this property lies adjacent to the city’s urban growth boundary (UGB). As provided <br />for in the Metro Plan, the annexation process establishes the specific alignment of the UGB for the <br />affected properties. Detailed findings regarding this determination are provided in the attached <br />findings (Exhibit C). <br /> <br /> <br />BACKGROUND <br />In December 2007, the City Council adopted an ordinance establishing the procedures for <br />annexation requests and amending Chapter 9 of the Eugene Code (EC) to include these <br />procedures. These annexation procedures provide for the council to adopt a resolution approving, <br />modifying and approving, or denying an application for annexation; or provide for the council to <br />hold a public hearing before consideration of the annexation request. <br /> <br />Approval of annexation requests are based on the criteria in EC 9.7825 which require that (1) the <br />land proposed to be annexed is within the city’s Urban Growth Boundary (UGB) and is contiguous <br />to the city limits or separated from city limits only by a right-of-way or water body; (2) the <br /> S:\CMO\2013 Council Agendas\M130408\S1304083D.doc <br /> <br />
