<br />ORDINANCE NO. 20310 <br /> <br />AN ORDINANCE PROVIDING FOR WITHDRAWAL OF TERRITORIES <br />FROM THE RIVER ROAD WATER DISTRICT AND THE RIVER ROAD <br />PARK AND RECREATION DISTRICT, AND FROM THE SANTA <br />CLARA WATER DISTRICT. <br /> <br />The City Council of the City of Eugene finds that: <br /> <br />A. Resolution No. 4785 adopted on January 26,2004, proposed withdrawal from the <br />River Road Water District, the River Road Parks and Recreation District, and the Santa Clara <br />Water District ("the Districts"), the parts of the Districts annexed to the City as described therein. <br /> <br />B. The Resolution set February 23, 2004, at 8:00 P.M., Pacific Time, in the Council <br />Chambers, City Hall, in Eugene, Oregon, as the time and place for hearing objections to the <br />withdrawals, and directed that notice of the time and place of the hearing be published once each <br />week for two successive weeks prior to the hearing and that the notice be posted in four public <br />places in the City for the same period. The Notice has been so published in the Register Guard <br />and posted in four public places in the City of Eugene, Oregon. <br /> <br />C. The City is willing to assume the liabilities and indebtedness previously <br />contracted by the Districts proportionate to the parts of the Districts that have been annexed to <br />the City upon the effective date of the withdrawals. <br /> <br />D. The withdrawals of the annexed territories from the Districts are consistent with <br />the fundamental principles and applicable policies of the Eugene-Springfield Metropolitan Area <br />General Plan, and other adopted City policies, and it is in the best interest of the City that the <br />territories be withdrawn. <br /> <br />NOW, THEREFORE, <br /> <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br /> <br />Section 1. The territory in Lane County, Oregon, annexed to the City of Eugene on April <br />28, 2003, by Notice of the Lane County Local Government Boundary Commission dated <br />October 29,2003, as bounded and described as follows: <br /> <br />Tax Lot 5100, Assessor's Map 17-04-23-12, located in the River <br />Road region of north Eugene, south of Beltline Road, west of <br />River Road, north of Horn Lane, east of Lake Drive, west of Oak <br />Drive, and more particularly described on Exhibit A attached <br />hereto and incorporated herein by reference (Stevens/Stahl, EC <br />ED 03-10) <br /> <br />Ordinance - 1 <br />
