<br />NOTICE OF PUBLIC HEARING OF
<br />THE EUGENE CITY COUNCil
<br />Monday, May 8, 2006

<br />On Monday May 8, 2006 at 7:30
<br />p.m. in the City Council Chamber
<br />at 177 Pearl Street, Eugene, Or
<br />egon, the Eugene City Council
<br />will hold a public hearing to con
<br />sider the following ordinance:
<br />AN ORDINANCE CONCERNING
<br />THE CHANGE OF STREET NAME
<br />OF THE 3RD/4TH CONNECTOR
<br />WHICH EXTENDS EAST FROM
<br />LINCOLN STREET TO PEARL
<br />STREET WITHIN THE CITY OF
<br />EUGENE, TO . SHELTON McMUR
<br />PHEY BOULEVARD.
<br />The adoption of the ordinance
<br />is concerning the following item:
<br />Street Name Change: 3rd!4th
<br />Connector (3rd/4th Avenue) to
<br />Shelton McMurphey Boulevard
<br />(File Number SC 06-1)
<br />The City Council will consider a
<br />proposal to change the existing
<br />street name from "3rd/ 4th Con
<br />nector" (also know as "3rd!4th
<br />Avenue") to "Shelton McMur
<br />phey Boulevard". The 3rd/4th
<br />Connector is a street located east
<br />of Lincoln Street and west of
<br />Pearl Street; north of the rail
<br />road tracks and south of Skinner
<br />Butte Park. Three properties
<br />abutting the street have an ad
<br />dress with the existing street
<br />name: 160 East 4th Avenue; 1
<br />West 4th Avenue; and 150 West
<br />4th Avenue. The proposal would
<br />change those addresses to "Shel
<br />ton McMurphey Boulevard" ad
<br />dresses.
<br />Applicable Criteria I
<br />The Eugene City Council shall i
<br />apply the following approval cri
<br />teria from the Eugene Code, Sec
<br />tion 9.8485, to the proposed
<br />street name change:
<br />EC 9.8485 Street Name Change
<br />Approval Criteria: The planning
<br />commission shall recommend,
<br />and the city council shall ap
<br />prove an application for a street
<br />name change upon determining
<br />that a proposed renaming is in
<br />the best interest of the city.
<br />Street name c.hange applica-
<br />tions are subject to review as a
<br />Type IV application pursuant to
<br />the Eugene Code Sections EC
<br />9.7400 through EC 9.7455; and
<br />Sections EC 9.7065 through EC
<br />9.7095 (quasi-judicial hearing
<br />procedures).

<br />How to Submit Testimony
<br />Testimony may be submitted in
<br />three ways:
<br />1. Send a written statement to
<br />the City Council. In accordance
<br />with Resolution No. 2641 of the
<br />Common Council of the City of
<br />Eugene, all written material to be
<br />considered by the Council must
<br />be submitted to the City
<br />Manager's Office, 777 Pearl
<br />Street, Room lOS, Eugene,
<br />Oregon 97401, no later than 10:00
<br />a.m. on Wednesday, May 3, 2006.
<br />2. Submit a statement at the
<br />hearing; however, the City
<br />Council will have less of an
<br />opportunity to read it before tak
<br />ing action.
<br />3. Attend the public hearing
<br />and state your concerns. Your
<br />spoken testimony will be
<br />recorded in the minutes of the
<br />hearing.
<br />All written materials that have
<br />been submitted to the Planning
<br />Commission concerning this
<br />matter have been forwarded to
<br />the City Council.
<br />Testimony and evidence of
<br />those testifying should be
<br />directed toward the applicable
<br />criteria described above, or other
<br />criteria in the applicable plan or
<br />land use regulation that the
<br />person testifying believes apply
<br />to the decision. The applicable
<br />refinement plan for this area is
<br />theWhiteaker Plan. ;

<br />You may also state your
<br />opinion to your neighborhood
<br />group. This application prlmarily
<br />affects residents of the Down-
<br />town Neighborhood Association
<br />and the Whiteaker Coummunity
<br />Council neighborhood group. To
<br />contact the neighborhood groups,
<br />call the Neighborhood Liaison
<br />Office at 682-5009 or visit the
<br />website at www.eugene-or.gov.
<br />Conduct of the Public Hearing
<br />The general order of the
<br />hearing is as follows (it is council
<br />policy to limit the time allowed
<br />for people providing oral test-
<br />imony to 3 mmutes):
<br />1. Eugene Mayor will com-
<br />mence the public hearing.
<br />2. The Mayor will ask
<br />Councilors to disclose any
<br />conflicts of Interest, ex parte
<br />contacts, and biases, abstentions
<br />or challenges . to impartiality
<br />submitted pur- suant to EC
<br />9.7065.
<br />3. Council will receive a City
<br />staff report and Councilors will
<br />share any information learned
<br />from site visits.
<br />4. Public testimony from the
<br />applicant and others in support of
<br />the application.
<br />5. Comments or questions from
<br />interested people who are
<br />neutral.
<br />6. Public testimony from those
<br />in opposition to the application.
<br />7. Staff response to testimony.
<br />8. Rebuttal by the applicant.
<br />9. Mayor will announce
<br />whether the record is closed;
<br />record will be held. open; or the
<br />public hearing will be continue~.

<br />regulations Pertaining to
<br />discrimination, including
<br />Americans with Disabilities Act of
<br />1990 .(ADA). Individuals with

<br />other documents and evidence,
<br />the applicable criteria are
<br />available for free inspection at
<br />the Eugene Planning and
<br />Develop- ment Department, First
<br />Floor Reception, 99 West 10th
<br />Avenue, Eugene, Oregon,
<br />between 1:00 p.m. and 5:00 p.m.
<br />Copies may be obtained at a rea
<br />sonable cost. The Planning
<br />Division staff report to the City
<br />Council will be available by 3:00
<br />p.m. on Monday, May 1, 2006, at
<br />the same location. The report will
<br />be available free of charge.
