The provisions, standards, and development criteria in the proposed S-DR Zone <br />satisfy remaining policies, fulfill the implementation strategies, and execute projects for the subject <br />site within the Downtown Plan. The proposed amendments are consistent with the remaining <br />portions of the plan. <br />The proposed amendments to the Riverfront Park Study are consistent with the purpose of updating <br />the plan to reflect a new community policy. These policies proposed for removal are obsolete as <br />they pertain to elements of the site that are no longer pertinent or remain. The proposed <br />amendments will not affect the plan’s ability to regulate and guide development within its <br />boundaries and are consistent with remaining portions of the plan. This criterion is satisfied. <br />(2) The refinement plan amendment addresses one or more of the following: <br />(a) An error in the publication of the refinement plan. <br />(b) New inventory material which relates to a statewide planning goal. <br />(c) New or amended community policies. <br />(d) New or amended provisions in a federal law or regulation, state statute, state <br />regulation, statewide planning goal, or state agency land use plan. <br />(e) A change of circumstances in a substantial manner that was not anticipated at the time <br />the refinement plan was adopted. <br />The proposed amendments do not address an error in the publication of the applicable refinement <br />plan, new inventory materials related to statewide planning goals, new or amended state or federal <br />laws, regulations or policies or a change of circumstances not anticipated at the time of plan <br />adoption. Therefore, criteria EC 9.8424(2)(a), (b), (d), and (e) above are not applicable to the <br />proposed amendments. Pursuant to subsection (c), the proposed amendments address new or <br />amended community policies, as described below. <br />In 2001, the City Council adopted amendments to TransPlan, the Metro Plan, and the land use <br />code to implement a nodal development strategy. The majority of the subject site is identified to <br />implement a nodal development strategy and is designated as such by the Metro Plan land use <br />diagram. The proposed amendments apply the nodal development (ND) designation to five (5) <br />parcels within the subject site that do not currently have the ND designation, resulting in all <br />properties within the subject site having the ND designation. The proposal implements the nodal <br />development strategy, as described in findings addressing consistency with the Metro Plan policies <br />for EC 9.7730(3)(b), consistent with this criterion. The Master Plan was completed using existing <br />Downtown Plan policies 3.A. through D. as guiding principles. The Downtown Plan and the <br />Riverfront Park Study have not been updated to reflect the new and amended community policies <br />as established in the SAP and SAZ and represented in the Master Plan.
