AMENDMENT OF CITY OF EUGENE'S SMOKING POLICY
APPLICABLE TO ALL CITY OWNED OR LEASED FACILITIES AND
VEHICLES, AND REPEAL OF ADMINISTRATIVE ORDER NO. 44 -93-
02.
The City Manager of the City of Eugene finds that:
A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002,
the City Manager is designated as the administrative head of the City, specifically authorized to
appoint and remove all employees (except as otherwise provided in the Charter), organize, and,
as deemed necessary, disband and reorganize various City departments, and to enforce all
ordinances of the City.
B. On May 18, 1993, Administrative Order No. 44 -93 -02 was issued adopting the
City of Eugene's smoking policy applicable to all City owned or leased facilities and vehicles.
C. The City has recently amended its Administrative Policy Manual to add electronic
cigarettes as a prohibited smoking instrument in indoor work areas at all facilities owned, leased,
and operated by the City, including motor vehicles. It is necessary to amend the City's smoking
policy adopted by Administrative Order No. 44 -93 -02 so that it is consistent with the
amendments made to the Administrative Policy Manual.
Now, therefore, based upon the above findings, I order that:
Order.
1. Administrative Order No. 44 -93 -02 is repealed as of the effective date of this
2. The City's smoking policy is amended to provide as follows:
City of Eugene Smoking Policy
1. This Policy applies to all employees, agents, and members of the
public when inside City owned or leased facilities or vehicles. For purposes of
this Policy, smoking instruments and devices are defined as: cigarettes, cigars,
electronic cigarettes, and pipes.
2. The use of any lighted or electronic smoking instrument or device
is strictly prohibited in indoor work areas at all facilities owned, leased and

operated by the City of Eugene, including all motor vehicles and motorized
equipment owned, leased and operated by the City of Eugene, unless such use is
expressly permitted by a collective bargaining agreement.
3. The Directors of individual departments may elect to prohibit the
oral use of tobacco products (i.e., chewing tobacco) upon finding that vehicle
and /or facility cleanliness is being adversely affected by the use of such products.
4. Smoking will be allowed in designated outdoor patios, balconies,
walkways and other outdoor areas as long as smoke or vapor does not infiltrate
another work area.
3. The Airport Manager is directed to implement this Policy through erection of
signs prohibiting smoking in all areas inside the terminal, pursuant to Airport Rule 4.16
