ISSUE STATEMENT
On November 15, 2004, the Eugene City Council will hold a public hearing on an ordinance to amend
the Laurel Hill Plan to change the land use designation from Low Density Residential to Commercial;
and change the zone of the Furtick/Larson property from R-1 Low Density Residential to C-2
Community Commercial.
BACKGROUND
This item has not previously come before the City Council. Action by the City Council is scheduled for
November 22, 2004.
The Planning Commission deliberated on these requests on October 25, 2004, after hearing testimony at
a public hearing on September 14, 2004. The Planning Commission voted 4 to 2 to recommend to the
City Council approval of the refinement plan amendment and zone change requests. Commissioners
Lawless, Levis, McMillan, Rusch voted in favor, commissioners Belcher and Colbath in opposition.
Commissioner Duncan was absent.
During their deliberation, in which the commissioners generally agreed that the site is not well suited for
residential development, some commissioners discussed the following issues:
· Lack of understanding of what "public need" for designating the site commercial means;
· The inability to consider mitigation requirements, such as buffering or a site review overlay, as a
condition of the requested refinement plan amendment or zone change;
· Frustration that the neighborhood refinement plan is out of date and hampers appropriate
decision-making; and
· The inability to consider this refinement plan designation change in the context of the entire
refinement plan, rather than an independent change to one site.

The Planning Commission considered one substitute motion and one amendment to the motion. The
attached draft minutes reflect the discussion in more detail. Further discussion is also included in the
attached staff report and memo dated September 7, and October 14, 2004.
RELATED CITY POLICIES
These refinement plan amendment and zone change requests rely upon conformance to policies within
the Metro Plan and the Laurel Hill Plan. Discussion of the relevant policies and consistency of the
proposal with these policies are included in staff evaluations for the Planning Commission in
Attachments A, C, and D.
The proposal relates to the Council Goal regarding Sustainable Community Development, which states:
A community that retains a high quality of life anda healthy economy, effectively links landuse and
transportation planning, and successfully manages growth and change in the urban environment.
The proposed ordinance addresses linkages between transportation planning and appropriate land uses.
Provision of commercial lands in appropriate locations promotes a healthy economy.
COUNCIL OPTIONS
None; this is a public hearing only.
CITY MANAGER'S RECOMMENDATION
Public hearings are required to follow quasi-judicial proceedings. Action is proposed on this item at the
City Council November 22, 2004, meeting.
SUGGESTED MOTION
No action is proposed at this City Council meeting.
