HomeMy WebLinkAboutAdmin Order 58-14-15ADMINISTRATIVE ORDER NO. 58 -14 -15 of the Traffic Engineer of the City of Eugene AMENDING THE CARSHARING PROGRAM AND REPEAL OF ADMINISTRATIVE ORDER NO. 58-10-05. The Traffic Engineer of the City of Eugene finds that: A. Section 5.040 of the Eugene Code, 1971 (EC) authorizes the City Manager or the Manager's designee to take administrative action establishing parking area time limitations, including the form of permissible parking and imposing conditions upon which the streets and other public property may be used for parking. B. On December 21, 2000, the City Manager issued Administrative Order No. 58- 00-29 appointing me as Traffic Engineer and delegating to me the City Manager's duties under EC 5.040, 5.050, 7.405, 7.410, and 9.538(6)(d). On September 24, 2009, the City_ Manager issued Administrative Order No. 58 -09 -14 which confirmed delegation of authority to the Traffic Engineer to exercise all of the duties and responsibilities specifically defined as those of the City Manager in EC 5.040 and EC 5.050 of the Eugene City Code. C. On June 30, 2010, the Traffic Engineer adopted Administrative Order No. 58 -10- 05 establishing a carsharing program intended to reduce air pollution and congestion and increase transit ridership, biking and walking. D. In order to expand the current carsharing program to allow for different approaches to carsharing to.operate within the City, the City needs to provide flexible parking conditions for Flex -Drive Organizations. Now, therefore, based upon the above findings, I order that: 1. Administrative Order No. 58 -10 -05 is repealed as of the effective date of this Order. 2. As of the effective date of this Order, the City's carsharing program is amended to provide as follows: CARSHARING PROGRAM 1. Purpose The Carsharing Program is intended to fulfill the following purposes: a. Establish a transparent, fair and consistent policy for carsharing in Eugene; Administrative Order -- Page 1 of ,5 b. Ensure a balance is achieved between City revenue and the goal of reducing City traffic congestion and demand for parking; C. Decrease single occupancy vehicle use; d. Decrease carbon pollution emission; e. Increase transit use, bicycling, and walking; £ Provide a reasonably affordable and accessible transportation option for residents; g. Expand the transportation alternatives of citizens who choose not to own cars by sponsoring the Carsharing Program; and h. Encourage more pedestrian- friendly, walkable neighborhoods. 2. Definitions For the purposes of this Administrative Order, the following definitions shall apply: Carsharing. A membership based organization that offers use of motor vehicles 24 hours a day and seven days a week to its members who can use available vehicles that are parked within a specific geographic boundary or who reserve vehicles in advance, and that charges members for the time and/or miles. Carsharing Program. The City of Eugene's program that authorizes carsharing organizations to provide carsharing in the City right -of -way. Carsharing permit. The revocable permit issued by the City authorizing a carsharing organization to park their vehicles either 1) in designated and reserved carsharing on- street spaces; or 2) in legal, on- street parking spaces. The City may issue individual permits by carsharing space, carsharing vehicle, or carsharing organization. Permit(s) must be displayed as directed by the City. Carsharing organization. An organization that provides pre- approved members with access to vehicles at geographically distributed locations for an hourly rate that includes fuel, maintenance, and insurance. Carsharing vehicle. A vehicle provided by a carsharing organization for use by its members. Each carsharing organization shall display its identifying emblem on any carsharing vehicle using on- street spaces. Carsharing on- street space. A non - metered, on- street space designated and reserved by the City for use by a carsharing organization. Administrative Order -- Page 2 of 5 Flex -Drive Organization. A carsharing organization that provides to its members access to carsharing vehicles parked within a specified geographic boundary inside the city limits. Legal, on- street parking space. A public on- street parking space that is 1) metered and provides at least a 60- minute time limit; 2) non - metered and not otherwise restricted; or 3) non - metered, restricted to a time limit of 60 minutes or more, and not otherwise restricted at certain times, such as restricted overnight parking, commercial loading zones, handicap spaces or carsharing on- street spaces. 3. Parking Space Designation and Use a. . The Carsharing Program will make available one on- street space. b. Each authorized carsharing organization may use one on- street space. C. Carsharing on- street spaces will be reserved for the exclusive use of one carsharing organization at all times, and may not be used by any other carsharing organization. d. If, a construction or maintenance project necessitates the removal of an existing carsharing on- street space, the City will work with the affected carsharing organization to find a suitable alternative location. 4. Carsharing Permits a. Applications for carsharing permits shall be submitted on the City- approved form. b. The Parking Services Manager is authorized to issue carsharing permits. C. A carsharing permit shall be valid for one year and may be renewed on an annual basis. d. Fees for carsharing permits shall be adopted in accordance with EC 2.020 and EC Chapter 5. e. A carsharing permit does not guarantee a parking space. 5. Location of Carsharing Spaces a. Carsharing on- street spaces shall be installed on Orchard Street, currently defined as the block area bounded by Franklin Boulevard and 15 Avenue. The City has the authority to redefine these boundaries. Administrative Order -- Page 3 of 5 b. Carsharing organizations may submit requests to install new carsharing spaces or move existing carsharing spaces. Upon receipt of requests, the City will conduct a site evaluation of each requested location. Evaluation factors include: (1) Parking space attributes (e.g., metered or signed); (2) Existing parking supply in requested location; (3) Demand for parking (commercial activity needs); and (4) Traffic safety. C. The Parking Services. Manager is authorized to approve or deny such requests. d. Approved carsharing on- street spaces will be installed or relocated in a timely manner. City staff will promptly notify the requesting carsharing organization of any delays. 6. Flex -Drive Organizations Notwithstanding any other provision of this order or any other administratively adopted order or rule, the following provisions apply to Flex -Drive Organizations: a. A carsharing vehicle operated as part of a Flex -Drive Organization may be parked at any available, legal, on- street parking space within the Flex -Drive Organization's designated geographic boundary, so long as: (1) The Flex -Drive Organization purchases a residential parking zone permit and commuter parking zone permit for every zone within the Flex -Drive Organization's designated geographic boundary for each vehicle authorized to park within that boundary; and (2) No carsharing vehicle that is operated as part of a Flex -Drive Organization may be stored on a street for more than 72 hours in violation of EC 5.135(1). b. The Flex -Drive Organization shall purchase for each carsharing vehicle a " carsharing permit, the residential and commuter parking zone permits for those established parking zones within the organization's designated geographic boundary, and pay estimated meter charges. 7. Responsibilities of Carsharing Organizations a. To be eligible for the Carsharing Program, organizations must meet the definition of "carsharing organization" above. b. Carsharing organizations must pay all permit fees to the City: Administrative Order -- Page 4 of 5 Carsharing organizations will provide the name and address of participants responsible for citations and towing fees incurred by their vehicles. If participant identities are not provided, the Carsharing organization will be responsible for payment. d. If the designated carshare parking space is occupied by an unpermitted vehicle, it is the carsharing organization's responsibility to contact parking services to notify them of the violation. The City is not responsible for finding the carsharing organization an alternate on- street parking space. Carsharing organizations shall meet all requirements of the carsharing permits. f. Carsharing organizations are responsible for promptly moving carsharing vehicles upon notification or may face enforcement action, including citation or towing. g. Violation of any of these responsibilities will result in one 30 -day notice per permit year to resolve the issue. Following that notice, failure to resolve the issue to the City's satisfaction may result in revocation of the permit. Dated and effective this day of September 2014. Thomas C.
