HomeMy WebLinkAboutAdmin Order 58-15-01ADMINISTRATIVE ORDER NO. 58-15-01 of the City Manager APPOINTING MARK SCHOENING AS HEARINGS OFFICER FOR APPEAL OF CIVIL PENALTIES ISSUED PURSUANT TO SECTION 6.446 OF THE EUGENE CODE, 1971. The City Manager of the City of Eugene finds that: A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002, the City Manager is designated as the administrative head of the City, specifically authorized to appoint and remove all employees (except as otherwise provided in the Charter), organize, and, as deemed necessary, disband and reorganize various City departments, and to enforce all ordinances of the City. B. Section 6.446 of the Eugene Code, 1971 (EC), sets out the City's regulations concerning discharge of foreign matter. C. The City Manager or the Manager's designee may issue a notice of violation for any violation of EC 6.446, and a person who is issued a notice of civil penalty may appeal the penalty to a Hearings Officer using the process prescribed in EC 2.021. D. It would be most efficient and in the public interest to appoint Mark Schoening to act as Hearings Officer to hear and make determinations on appeals of civil penalties issued pursuant to EC 6.446. On the basis of these findings, I order that Mark Schoening is appointed as the Hearings Officer to hear and make determinations on appeals of civil penalties issued pursuant to Section 6.446 of the Eugene Code, 1971.
