HomeMy WebLinkAboutAdmin Order 58-15-25ADMINISTRATIVE ORDER NO. 58-15-25 of the City Manager EMERGENCY RULE AMENDING THE AIRPORT RULES. The City Manager of the City of Eugene finds that: A. Pursuant to the authority contained in Sections 2.019 and 2.430 of the Eugene Code, 1971, the current Rules Governing the Use of Mahlon Sweet Airport ("Airport Rules") were adopted by Administrative Order No. 58-07-01-F of the City Manager on February 12, 2007. B. Due to the passage of Measure 91 which became effective on July 1, 2015, persons are permitted to carry up to one ounce of marijuana within the state. However, state law prohibits marijuana from being transported outside of Oregon. In order to comply with state and federal law related to transporting marijuana outside of the state of Oregon, it is necessary to add an Airport Rule that prohibits persons from possessing marijuana in any restricted area of the Airport unless the person's flight destination is within the state of Oregon or the marijuana is medical. C. This Rule must be implemented immediately because Measure 91 is currently in effect, and failure to act promptly may result in the City of Eugene's non-compliance with state and federal law. Adoption of this Emergency Rule is authorized by subsection (6) of Section 2.019 of the Eugene Code, 1971. NOW, THERFORE, based upon the above finding which are adopted, and pursuant to the authority in Sections 2.019(6) and 2.430 of the Eugene Code, 1971, 1 order that: 1. This Rule amendment shall become effective immediately and remain in effect for a period of 180 days from the date this Order is signed unless replaced earlier by an emergency rule, temporary rule, or permanent rule adopted in accordance with the provisions of Section 2.019 of the Eugene Code, 1971. 2. A copy of this Administrative Order shall be appended to Administrative Order No. 58-07-01-F. 3. Paragraph 4.18 is added to the Airport Rules as provided below. RULES GOVERNING USE OF MAHLON SWEET AIRPORT 4. RULES OF GENERAL APPLICABILITY. 4.18 Marijuana. Except for Persons who can demonstrate that their final flight destination is within the State of Oregon, no Person shall possess marijuana in any Restricted Administrative Order - Page 1 of 2 Area of the Airport. For purposes of this Rule, marijuana means all parts of the plant of the genus cannabis, whether or not growing, the seeds thereof, the resin extracted from any part of the plant, and every compound, manufacture, salt, derivative, mixture, or preparation of the plant, its seeds or its resin, including marijuana concentrate and marijuana products and consumables. For purposes of this Rule, marijuana does not include medical marijuana as that term is defined under Oregon law. Dated and effective this /&ay of July, 2015. L n R.
