HomeMy WebLinkAboutAdmin Order 58-15-29ADMINISTRATIVE ORDER NO. 58-15-29 of the Traffic Engineer of the City of Eugene AMENDING THE BOUNDARIES OF RESIDENTIAL PERMIT PARKING ZONE B IN THE WEST UNIVERSITY NEIGHBORHOOD ASSOCIATION (WUNA) AREA; REPEALING ADMINISTRATIVE ORDER NOS. 58-91-07, 58-01-01 AND 58-01-09 AND ANY OTHER PREVIOUSLY ADOPTED ADMINISTRATIVE ACTIONS REGARDING THE WUNA RESIDENTIAL PERMIT PARKING ZONE B AND COMMUTER PERMIT D; AND PROVIDING A SEVERABILITY CLAUSE. The Traffic Engineer of the City of Eugene finds that: A. EC 5.040 authorizes the City Manager or the Manager's designee to take administrative action establishing parking area time limitations, including the form of permissible parking and imposing conditions upon which the streets and other public property may be used for parking. B. Pursuant to the above -authority, the City Manager adopted Administrative Order No. 58-92-07, adopting Residential Permit Parking Zone Regulations, Administrative Rule R- 5.040. C. Administrative Rule R -5.040-C provides that the Traffic Engineer ,may establish a residential permit parking zone upon the application by an owner/residential or, in an area for which no owner/resident application has been received, provided that: (a) establishment of the zone is necessary in order to meet the objectives of the policies set forth herein; (b) the proposal would meet the criteria for approval set forth in R -5.040-F had an application been submitted; and, (c) failure to establish a zone would create a hardship for residents in the area or contribute to traffic congestion in the area. D. In 1991, the Traffic Engineer adopted Administrative Order No. 58-91-07 establishing residential permit parking Zones B, C and C -D (commuter permit D) for property located within the West University Neighborhood Association (WUNA). Since that time, the Traffic Engineer has adopted Administrative Order Nos. 58-01-01 and 58-01-09 which expanded Zone B residential permit parking throughout the WUNA area. E. In accordance with Administrative Rule R -5.040-C, expanding the existing boundaries of the WUNA residential permit parking Zone B is necessary to meet the objectives Administrative Order -- Page 1 of 3 of the policies set forth in Administrative Rule R-5.046 and meets the criteria for approval set forth in R -5.040-F. Failure to establish the zone would create a hardship for the area's residents and would contribute to traffic congestion in the area. On the basis of these findings, I order that: 1. Notwithstanding any other Administrative Order to the contrary, the area depicted on the map attached hereto and incorporated herein as Exhibit A, and as described specifically below, is hereby established as residential permit parking Zone B. High Street: East Side from E. 18th Avenue to E. 13th Avenue E. 14th Avenue: North Side from High Street to Mill Street Mill Street: West Side from E. 14th Avenue to E. 13th Alley E. 13th Alley: South Side from Mill Street to Patterson Street Patterson Street: West Side from E. 13th Avenue to E. 18th Avenue E. 18th Avenue: North Side from Patterson Street to High Street Mill Street: East and West Sides between E. 13th Alley and E. 13th Avenue Ferry Street: East and West Sides between E. 13th Alley and E. 13th Avenue 2. The area designated as Zone B on Exhibit A and specifically described in paragraph 1 above, shall allow up to two hours public parking between 7:00 a.m. and 6:00 p.m., Monday through Friday, except legal holidays and except Zone B permitted vehicles. 3. Persons residing in or owning residential property within Zone B designated herein may apply for a permit entitling the holder thereof to preferential long-term parking within the designated zone. Permit fees shall be established in accordance with Section 2.020 and Chapter 5 of the Eugene Code, 1971. Permit sales shall be processed on a first come, first serve basis and shall not exceed 50% of the existing on -street parking spaces. 4. Homeowners are eligible for an annual residential permit. For purposes of residential permit parking, "homeowner" means: (a) An owner/occupant who (1) is an owner of record of the property as shown on the most recent Lane County Assessor's tax roll, and (2) occupies a dwelling on the property for a minimum of 6 months of each calendar year; or (b) A person who does not own the property but has resided at the address associated with the property for more than four years. Administrative Order -- Page 2 of 3 Prior to permit issuance, a "homeowner" must provide the city with two forms of documentation to verify the applicable occupancy/residency requirement. Acceptable documentation includes voter's registration, driver's license, homeowner's insurance, income tax filing, and/or utility bill. A "homeowner" under subsection (a) of this provision must also provide the city with a copy of the property deed to verify ownership. 5. Administrative Order Nos. 58-91-07, 58-01-01 and 58-01-09 and any other previously adopted administrative actions establishing boundaries of the WUNA residential permit parking Zone B and commuter permit D are repealed. 6. If, by action of a hearing official having jurisdiction to review this administrative order, any portion of this administrative order is stricken or the boundaries of the WUNA residential permit parking Zone B is modified, such action by the hearings official shall have no effect on the validity of any other section or provision hereof, all of which will remain in full force and effect.
