HomeMy WebLinkAboutAdmin Order 44-15-03-FADMINISTRATIVE ORDER NO. 44-15-03-F of the City Manager of the City of Eugene ESTABLISHMENT OF A TRANSIENT ROOM TAX SERVICE FEE FOR CREDIT CARD PAYMENTS. The City Manager of the City of Eugene finds as follows: A. Section 2.020 of the Eugene Code, 1971, authorizes the City Manager of the City of Eugene to determine and set fees and charges to be imposed by the City for services, goods, use of municipal property, and licenses and permits. B. The City has provided businesses paying Transient Room Tax payments the option to pay by credit card. This is offered as a convenience to the businesses. The City's merchant account provider charges fees for processing Transient Room Tax credit card payments, which the City has been absorbing. The processing fees have increased tenfold since 2006. Due to the increasing processing fees, on July 10, 2015, I issued Administrative Order No. 44-15-03 proposing to establish a 2.9% service fee for credit card payments of Transient Room Taxes in order to pass-through the processing fee onto businesses that pay by credit card. Notice of the proposed fee was attached as Exhibit A to Administrative Order No. 44-15-03. C. A copy of the Notice was provided to the Mayor and City Councilors, and made available to persons who had requested such notice. A copy of the Notice was also posted at two locations at City Hall on July 15, 2015. The Notice provided that written comments would be received for a period of 15 days from the date of posting. No comments were received within the time or in the manner provided in the Notice. D. In determining the fee, I have considered the applicable policies, enactments and directives of the City Council, the full costs of providing the service supported by the fee, and the amounts charged by other comparable providers. I have not considered the amount charged for this service by the City in the past because the City has not previously charged a Transient Room Tax service fee. Nor have I considered the revenue needs of the City as determined by the adopted City budget because the decision to establish this service fee was not determined as part of the budget process. On the basis of these findings, I order that businesses paying Transient Room Taxes by credit card shall be charged a 2.9% service fee. The City shall not receive any portion of the service fee; rather, proceeds from the service fee shall be remitted directly to the City's merchant account provider to cover the cost of processing the credit cards.
