MetroPlanAmendments(fileno.MA151) The MetroPlan landusediagramisproposedforamendmentfortheentire74acreproperty,from ParksandOpenSpacetoLowDensityResidentialdesignation.EugeneCode(EC)Section9.7730 requiresthatthefollowingapprovalcriteria(in bolditalics)beappliedto MetroPlan amendments: (1)TheamendmentisconsistentwithapplicablestatewideplanninggoalsadoptedbytheLand ConservationandDevelopmentCommission. Goal1CitizenInvolvement.Todevelopacitizeninvolvementprogramthatinsurestheopportunity forcitizenstobeinvolvedinallphasesoftheplanningprocess. TheCityhasacknowledgedprovisionsforcitizeninvolvementwhichinsuretheopportunityfor citizenstobeinvolvedinallphasesoftheplanningprocessandsetoutrequirementsforsuch involvement.Theamendmentsdonotamendthecitizeninvolvementprogram.Theprocessfor adoptingtheseamendmentscomplieswithGoal1becauseitisconsistentwiththecitizen involvementprovisions. TheCityofEugenelandusecodeimplementsStatewidePlanningGoal1byrequiringthatnoticeof theproposedamendmentsbegivenandpublichearingsbeheldpriortoadoption.Considerationof theamendmentsbeginswithaCityofEugenePlanningCommissionpublichearingonJuly14,2015. Theapplicantalsoheldaneighborhoodapplicantmeetingwhichwasnoticedtotheaffected neighborhoodorganizationandpropertyownersandresidentswithin300feetofthesubject property,perEC9.7007. Findings1 ExhibitC Subsequenttodeemingtheapplicationscomplete,onJune9,2015theCitymailednoticeofthe proposedplanamendmentstotheDepartmentofLandConservationandDevelopment,asrequired bytheEugeneCodeandinaccordancewithStatestatutes.Referralsconcerningthepending applicationsweresenttotheOregonDepartmentofTransportation(ODOT),CityofSpringfield,Lane County,theaffectedNeighborhoodAssociation(whichatthetimewasSoutheastNeighbors),andto Citydepartments.OnJune12,2015,noticeofthePlanningCommissionpublichearingwasmailedto theapplicant,ownersandoccupantsofpropertywithin500feetofthesubjectpropertyandthe SoutheastNeighborsandnoticewasalsopostedinaccordancewithEC9.7415(5).OnJune24,2015, noticeofthePlanningCommissionpublichearingwaspublishedintheRegisterGuard,inaccordance withtheEugeneCode.ThePlanningCommissionpublichearingwasheldonJuly14,2015,with deliberationsheldon{INSERTDATE}andactiontakeon{INSERTDATE}.Followingactionbythe PlanningCommission,theEugeneCityCouncilwillholdadulynoticedpublichearingtoconsider approval,modification,ordenialoftheplanamendmentsandzonechanges,scheduledfor{INSERT DATE}. TheprocessforadoptingtheseamendmentscomplieswithStatewidePlanningGoal1sinceit complieswiththerequirementsofthe{ƷğƷĻ͸ƭcitizeninvolvementprovisions. Goal2LandUsePlanning.Toestablishalanduseplanningprocessandpolicyframeworkasabasis foralldecisionsandactionsrelatedtouseoflandandtoassureanadequatefactualbasisforsuch decisionsandactions. TheEugenelandusecodespecifiestheprocedureandcriteriathatwereusedinconsideringthese amendments.Therecordshowsthatthereisanadequatefactualbasefortheamendments.The Goal2coordinationrequirementismetwhentheCityengagesinanexchange,orinvitessuchan exchange,betweentheCityandanyaffectedgovernmentalunitandwhentheCityusesthe Goal2 informationobtainedintheexchangetobalancetheneedsofthecitizens.Tocomplywiththe coordinationrequirement,theCityengagedinanexchangeaboutthesubjectoftheseplan amendmentswithalloftheaffectedgovernmentalunits.Specifically,theCityprovidednoticeofthe proposedactionandopportunitytocommenttoLaneCounty,SpringfieldandtheDepartmentof noexceptionstoStatewidePlanningGoal2required LandConservationandDevelopment.Thereare fortheseamendments.Therefore,theamendmentsareconsistentwithStatewidePlanningGoal2. Goal3AgriculturalLands.Topreserveagriculturallands. Theamendmentsareforpropertylocatedwithintheurbangrowthboundaryanddonotaffectany landdesignatedforagriculturaluse.Therefore,StatewidePlanningGoal3doesnotapply. Goal4ForestLands.Toconserveforestlands. Theamendmentsareforpropertylocatedwithintheurbangrowthboundaryanddonotaffectany landdesignatedforforestuse.Therefore,StatewidePlanningGoal4doesnotapply. Goal5OpenSpaces,ScenicandHistoricAreas,andNaturalResources.Toconserveopenspaceand protectnaturalandscenicresources. Findings2 ExhibitC OAR6600230250(3)provides:LocalgovernmentsarenotrequiredtoapplyGoal5inconsideration ofaPAPAunlessthePAPAaffectsaGoal5resource.Forpurposesofthissection,aPAPAwouldaffect aGoal5resourceonlyif: (a)ThePAPAcreatesoramendsaresourcelistoraportionofanacknowledgedplanorlanduse regulationadoptedinordertoprotectasignificantGoal5resourceortoaddressspecific requirementsofGoal5; (b)ThePAPAallowsnewusesthatcouldbeconflictinguseswithaparticularsignificantGoal5 resourcesiteonanacknowledgedresourcelist;or (c)ThePAPAamendsanacknowledgedUGBandfactualinformationissubmitteddemonstrating thataresourcesite,ortheimpactareasofsuchasite,isincludedintheamendedUGBarea. WhilethesubjectpropertydoesincludeaGoal5protectedstream,thesemapamendmentsdonot createoramendthe/źƷǤ͸ƭlistofGoal5resources,donotamendacodeprovisionadoptedinorder toprotectasignificantGoal5resourceortoaddressspecificrequirementsofGoal5,donotallow newusesthatcouldbeconflictinguseswithasignificantGoal5resourcesiteanddonotamendthe acknowledgedurbangrowthboundary.Therefore,StatewidePlanningGoal5doesnotapply. Goal6Air,WaterandlandResourceQuality.Tomaintainandimprovethequalityoftheair,water andlandresourcesofthestate. Goal6addresseswasteandprocessdischargesfromdevelopment,andisaimedatprotectingair, waterandlandfromimpactsfromthosedischarges.Themapamendmentsdonotaffectthe/źƷǤ͸ƭ abilitytoprovideforcleanair,waterorlandresources.Therefore,StatewidePlanningGoal6does notapply. Goal7AreasSubjecttoNaturalDisastersandHazards.Toprotectlifeandpropertyfromnatural disastersandhazards. Goal7requiresthatlocalgovernmentplanningprogramsincludeprovisionstoprotectpeopleand propertyfromthefollowingnaturalhazards:floods,landslides,earthquakesandrelatedhazards, tsunamis,coastalerosionandwildfires.TheGoalprohibitsadevelopmentinnaturalhazardareas withoutappropriatesafeguards.Thesubjectpropertyisnotlocatedwithinknownareasofnatural disastersorhazards.Thesubjectpropertyisoutsidethefloodzoneandisnotsubjecttohazards normallyassociatedwithwildfiresortsunamis.Otherhazardscanbemitigatedatthetimeof developmentbasedonacceptedbuildingcodesandbuildingtechniques.Themapamendmentsdo notaffectthe/źƷǤ͸ƭrestrictionsondevelopmentinareassubjecttonaturaldisastersandhazards Therefore,StatewidePlanningGoal7doesnotapply. Goal8RecreationalNeeds.Tosatisfytherecreationalneedsofthecitizensofthestateandvisitors, andwhereappropriate,toprovideforthesitingofnecessaryrecreationalfacilitiesincluding destinationresorts. Goal8ensurestheprovisionofrecreationalfacilitiestoOregoncitizensandisprimarilyconcerned withtheprovisionofthosefacilitiesinnonurbanareasofthestate.Goal8alsoallows,butdoesnot require,theCitytocreateaninventoryofrecreationalneeds.TotheextentthatGoal8isapplicable, Findings3 ExhibitC theCityhastwodocumentsrelatedtolongrangeparksplanning:theParks,RecreationalandOpen SpaceComprehensivePlan(PROS)anditslistofimplementingprojectsinthePROSProjectand PriorityPlan.OnlytheProjectandPriorityPlanhasbeenadoptedhowever,itwasnotadoptedasa landuseplan.Thereforeitcannotbeusedasabasisfordeterminingcompliancewiththeapplicable criteriainthiscase.Acknowledgingthislimitation,theCityhasconsultedthesedocumentsand determinedthefollowing: This74acresiteisprivatelyownedbytheRestHavenMemorialPark.Thepropertyownershave indicatedthatapproximately27.63acresisneededforexistingorfuturecemeteryuseandthey wouldliketomaketheremaining46.27acresavailableforresidentialuses.ThePROSProjectand PriorityPlanidentifiestheneedforaneighborhoodparkinthisvicinity;howeverthePROSProject andPriorityPlanstatesthatthelocationofproposedacquisitionsareapproximateandsubjectto changebasedonlandavailabilityandpublicinvolvement.Thepropertyownerhasindicatedno interestinsellinganyportionoftheirsiteforparksatthistime.Regardless,Cityparksareallowedin LDR/R1thereforeredesignationoftheentiresitetoLDRwouldnotprecludeafutureparknoraffect the/źƷǤ͸ƭprovisionsfororaccesstorecreationalareas,facilitiesorrecreationalopportunities. TotheextentStatewidePlanningGoal8applies,theamendmentsareconsistent. Goal9EconomicDevelopment.Toprovideadequateopportunitiesthroughoutthestateforavariety ofeconomicactivitiesvitaltothehealth,welfare,andprosperityofhƩĻŭƚƓ͸ƭcitizens. Goal9requirescitiestoevaluatethesupplyanddemandofcommercialandindustriallandrelativeto communityeconomicobjectives.TheAdministrativeRuleforStatewidePlanningGoal9(OAR660 Division9)requiresthattheCityͻΝƦΞƩƚǝźķĻforatleastanadequatesupplyofsitesofsuitablesizes, types,location,andservicelevelsforavarietyofindustrialandcommercialusesconsistentwithplan ƦƚƌźĭźĻƭΝ͵ΞͼAmongotherthings,therulerequiresthatcitiescompleteanͻ9ĭƚƓƚƒźĭOpportunities citiesaretoprepare !ƓğƌǤƭźƭ͵ͼOAR6600090015.BasedontheEconomicOpportunitiesAnalysis, IndustrialandCommercialDevelopmentPolicies.OAR6600090020.FinallyOAR6600090025 requiresthatcitiesdesignateindustrialandcommerciallandssufficienttomeetshortandlongterm needs.OAR6600090010(2)providesthatthedetailedplanningrequirementsimposedbyOAR660 ͻğƷthetimeofeachperiodicreviewoftheplan(ORSЊВА͵АЊЋΛЌΜΜ͵ͼTheEugene Division9apply CommercialLandsStudy(1992)andtheIndustrialMetropolitanIndustrialLandsInventoryReport (1993)wereadoptedbytheCityofEugeneasarefinementoftheMetroPlan,andcomplieswiththe requirementsofGoal9andthecorrespondingAdministrativeRule. Theproposedmapamendmentsdonotaddorsubtractanycommercialorindustriallandfromthe adoptedinventories;thereforeGoal9isnotapplicable. Goal10Housing. Goal10requiresthatcommunitiesplanforandmaintainaninventoryofbuildableresidentiallandfor neededhousingunits.TheAdministrativeRuleforStatewidePlanningGoal10(OAR660Division8) statesthatͻƷŷĻmixanddensityofneededhousingisdeterminedinthehousingneedsprojection. Sufficientbuildablelandshallbedesignatedonthecomprehensiveplanmaptosatisfyhousingneeds bytypeanddensityrangeasdeterminedinthehousingneedsprojection.Thelocalbuildablelands Findings4 ExhibitC inventorymustdocumenttheamountofbuildablelandineachresidentialplanķĻƭźŭƓğƷźƚƓ͵ͼThe comprehensiveplanmapforthecityisthe MetroPlan landusediagram.TheResidentialLandsStudy (1999)wasadoptedbytheCityofEugeneasarefinementofthe MetroPlan,andcomplies withthe requirementsofGoal10andthecorrespondingAdministrativeRule.Accordingtothe1999 ResidentialLandsStudy(RLS),thereissufficientbuildableresidentiallandtomeettheidentifiedland need. Thesubjectsiteisproposedtoberedesignatedtoaresidentialdesignation.TheRLSidentifiesthe undevelopedresidentiallandsupply(inventory)basedonthedesignationorzoningandthesizeof theparcel.Somedemandwasalsoassumedtobeaccommodatedthroughredevelopmentandinfill. ThissubjectsitewasnotidentifiedaspartoftheRLSsincealthoughitwaspartiallyzonedR1,itwas notvacantorinagriculturalortimberuseatthattime;thereforethisredesignationdoesnotreduce theRLSinventoryandisconsistentwithGoal10.However,theproposalwilladdapproximately46 acresofhousingcapacitytotheexistinglandsupply(excludinganyprotectedarea). Basedontheabove,theamendmentsareconsistentwithStatewidePlanningGoal10. Goal11PublicFacilitiesandServices.Toplananddevelopatimely,orderlyandefficientarrangement ofpublicfacilitiesandservicestoserveasaframeworkforurbanandruraldevelopment. Theamendmentsdonotaffectthe/źƷǤ͸ƭprovisionofpublicfacilitiesandservices.Therefore, StatewidePlanningGoal11doesnotapply. Goal12Transportation.Toprovideandencourageasafe,convenientandeconomictransportation system. TheTransportationPlanningRule(OAR6600120060)containsthefollowingrequirement: (1)Ifanamendmenttoafunctionalplan,anacknowledgedcomprehensiveplan,oralanduse regulation(includingazoningmap)wouldsignificantlyaffectanexistingorplanned placemeasuresasprovidedin transportationfacility,thenthelocalgovernmentmustputin section(2)ofthisrule,unlesstheamendmentisallowedundersection(3),(9)or(10)ofthisrule. Aplanorlanduseregulationamendmentsignificantlyaffectsatransportationfacilityifit would: (a)Changethefunctionalclassificationofanexistingorplannedtransportationfacility (exclusiveofcorrectionofmaperrorsinanadoptedplan); (b)Changestandardsimplementingafunctionalclassificationsystem;or (c)Resultinanyoftheeffectslistedinparagraphs(A)through(C)ofthissubsectionbasedon projectedconditionsmeasuredattheendoftheplanningperiodidentifiedintheadopted TSP.Aspartofevaluatingprojectedconditions,theamountoftrafficprojectedtobe generatedwithintheareaoftheamendmentmaybereducediftheamendmentincludes anenforceable,ongoingrequirementthatwoulddemonstrablylimittrafficgeneration, including,butnotlimitedto,transportationdemandmanagement.Thisreductionmay diminishorcompletelyeliminatethesignificanteffectoftheamendment. (A)Typesorlevelsoftraveloraccessthatareinconsistentwiththefunctionalclassification ofanexistingorplannedtransportationfacility; (B)Degradetheperformanceofanexistingorplannedtransportationfacilitysuchthatit Findings5 ExhibitC wouldnotmeettheperformancestandardsidentifiedintheTSPorcomprehensive plan;or (C)Degradetheperformanceofanexistingorplannedtransportationfacilitythatis otherwiseprojectedtonotmeettheperformancestandardsidentifiedintheTSPor comprehensiveplan. Theproposedmapamendmentsdonotchangethefunctionalclassificationofatransportation facilityorchangethestandardsimplementingafunctionalclassificationsystem.Therefore,the amendmentsdonothaveasignificanteffectunder(a)or(b). Inregardsto(c),thetypeofdevelopmentcurrentlypermittedthroughtheexistingplandesignation andzoningwillchangeforthesubjectproperty.Asdetailedinthefollowingfindings,theğƦƦƌźĭğƓƷ͸ƭ analysisindicatesthat:(A)thetypesandlevelsoftravelandaccessareconsistentwiththefunctional classificationofexistingtransportationfacilities;(B)noneofthetransportationfacilitiesstudiedwill bedegradedbeyondtheiridentifiedperformancestandardidentifiedin TransPlan asaresultofthe proposedamendments;and,(C)noneoftheexistingtransportationfacilitiesareotherwiseprojected tofallbelowtheperformancestandardsidentifiedin TransPlan. ToaddresstheTPR,theapplicantsubmittedfindingsandaTransportationImpactAnalysis(TIA), datedApril24,2015,whichwaspreparedbytheconsultingfirmofBranchEngineering,Inc.Staff clarifiesthatthisisnotaTrafficImpactAnalysis(TIA)ReviewpursuanttoEC9.8650,althoughoneis expectedtobeprovidedatthetimeofanewdevelopmentapplication.TheTIArespondsto commentsfromtheCityprovidedduringtheapplicationcompletenessreviewprocess.TheTIA evaluatesthecurrentperformanceofimpactedtransportationfacilities,theperformanceofthese facilitiesin2027withtheproposedamendmentsandtheperformanceofthefacilitiesin2027 withouttheproposedamendments.Sincetherearenotransportationfacilitiesplannedforthestudy impactsononlytheexistingtransportationfacilitieswithin area,theğƦƦƌźĭğƓƷ͸ƭanalysisconsidersthe thestudyarea. ComparisonofExistingandProposedLandUses Incomparingtheexistingandtheproposedlanduses,theğƦƦƌźĭğƓƷ͸ƭTIAassumesinbothscenarios thattheareacurrentlyusedorplattedascemeterywillremaincemetery.Fortheunusedportionof thepropertycurrentlydesignatedPOSandzonedR1,theğƦƦƌźĭğƓƷ͸ƭTIAusesregionalparkasthe existinglanduseandusesaͻƩĻğƭƚƓğĬƌĻworstĭğƭĻͼscenarioofsinglefamilyhousinglimitedtofive homesperacre(pertheSouthHillsStudypolicy)fortheproposeduse(Table3oftheTIA). AccordingtotheğƦƦƌźĭğƓƷ͸ƭTIA,thenumberofPMpeakhourtripsprojectedtobegeneratedby developmentallowedunderthereasonableworstcasescenarioareasfollows: RestHavenProjectedPMPeakProjectedPMPeakDifference MemorialParkTripsExistingTripsProposedbetweenland POSdesignation&RLDRdesignation&usetrips 1/PLzoneR1zone Existinglanduses: Cemetery23 Findings6 ExhibitC regionalpark9 Proposedlanduses: Cemetery23 singlefamily231 residential(5 homesperacre) +222 Becausethetripsgeneratedbytheproposedlanduseexceedthetripsoftheexistinglanduse(222 moretrips),ananalysisofwhetheranyapplicabletransportationfacilitieswillbeͻƭźŭƓźŅźĭğƓƷƌǤ źƒƦğĭƷĻķͼbythedevelopmentisnecessary. CitystaffwasconsultedinthescopinganddevelopmentoftheğƦƦƌźĭğƓƷ͸ƭTIAandgenerallyagrees thattheanalysismethodsusedintheğƦƦƌźĭğƓƷ͸ƭTIAareacceptable.The!ƦƦƌźĭğƓƷ͸ƭTIAincluded analysisofthefollowingexistingtransportationfacilities: TransportationFacilities StreetClassificationJurisdiction WillametteStreetMinorArterialCityofEugene DonaldStreetMajorCollectorCityofEugene CrestDriveLocalCityofEugene E.33AvenueNeighborhoodCollectorCityofEugene rd W.39AvenueNeighborhoodCollectorCityofEugene th E.40 th AvenueMajorCollectorCityofEugene DeterminationofSignificantEffect TheTPRrequiresadeterminationofwhichexistingandplannedtransportationfacilitieswill experienceasignificanteffectasaresultoftheproposedplanamendment,anddefineswhat constitutesasignificanteffect.Onewayinwhichanamendmentwillsignificantlyaffectanexisting orplannedtransportationfacilityis,ifattheendoftheplanningperiod,theamendmentwillreduce theperformanceofatransportationfacilitybelowtheminimumacceptableperformancestandardor willworsentheperformanceofatransportationfacilitythatisotherwiseprojectedtoperformbelow theminimumacceptableperformancestandard(OAR6600120060(1)(c)(B)and(C)). Indeterminingwhetherthereisasignificanteffect,differentmeasurementsareusedtoidentifyand analyzeeachfacilityfortheminimumlevelofperformancestandard.LevelofServiceD(LOSD)isthe minimumacceptableperformancestandardforthetransportationfacilitieswithintheğƦƦƌźĭğƓƷ͸ƭ studyarea.Asidentifiedin TransPlan,LOSArepresentstheleastcongestedconditionsandLOSFthe mostcongested. Theendoftheplanningperiodinthe/źƷǤ͸ƭadoptedtransportationsystemplan(TransPlan)is2027. Accordingly,theğƦƦƌźĭğƓƷ͸ƭanalysisunderOAR6600120060isforthe2027planningperiod.
