ADOPTION OF PUBLIC RECORDS RETENTION REQUIREMENTS
FOR FIRE DEPARTMENT DASH CAM VIDEOS.
The City Manager of the City of Eugene finds that:
A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002,
the City Manager is designated as the administrative head of the City, specifically authorized to
appoint, remove, and direct all employees (except as otherwise provided in the Charter), and to
enforce.all ordinances of the City.
B. Dash cams offer the potential to capture video footage of a scene, fire or accident
response which can be used primarily to assist in training Fire Department personnel through
after -action reviews. Less expensive "dash cams" are now available that enable the installation
at a relatively nominal cost in vehicles. The Fire Department is interested in testing the dash
cams to determine how useful they might be. However, the dash cams cannot record extensive
video footage without quickly running out of memory. Therefore, these dash cams are designed
to "loop over" the oldest footage since most of the footage while driving is recording random
scenes. Any footage capturing something significant can be protected from being recorded over
until that footage can be downloaded to a City server and preserved/retained similar to other City
video footage.
C. The State of Oregon has adopted Oregon Administrative Rules setting forth
public record retention requirements for cities. However, the State's retention requirements are
silent regarding the retention of dash cam video that serves no training or other purpose.
Therefore, it is necessary to adopt public records retention requirements in order to fill that gap.
NOW THEREFORE, the public records retention requirements for Fire Department
dash cam videos is adopted as set out below.
FIRE DEPARTMENT DASH CAM VIDEO RETENTION REQUIREMENTS
Dash cam video taken in Fire Department vehicles shall be retained as follows:
(1) Dash cam video that does not serve a training purposes or fall within any
of the other State -adopted record retention categories does not need to be

retained and may be recorded over pursuant to the normal operation of the
dash cam.
(2) Dash cam video of fires, accidents or other emergency scenes used for
training purposes shall be retained in accordance with OAR 166-200-
0330(2). Any other dash cam video that falls within a State -adopted
record retention category shall be retained in accordance with the State's
records retention schedule. Such video shall be downloaded from the
camera's SD card to City computers or servers as soon as practicable.
(3) The dash cam normally shall be operated with the audio recording
function off. If a battalion chief determines that training would be
furthered by activating the audio recording function in a particular
instance, the battalion chief may do so provided that he or she
concurrently ensures that the dash cam is set to retain that footage (i.e.,
ensure the dash cam will not loop over that footage), and in addition, the
battalion chief shall notify anyone in the Fire Department vehicle or
anyone who approaches the Fire Department vehicle that the dash cam is
operating and will record what the person says.
