of the
City Manager
DELEGATING TO THE EXECUTIVE DIRECTOR OF CENTRAL
SERVICES THE AUTHORITY TO ACCEPT OR REJECT REQUESTS
FOR DEFENSE AND INDEMNIFICATION.
The City Manager of the City of Eugene finds that:
A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002, the
City Manager is designated as the administrative head of the City, and is specifically authorized
to appoint and remove all employees (except as otherwise provided in the Charter), and to enforce
all ordinances of the City.
B. The City of Eugene has a legal responsibility to defend and indemnify its officers,
agents and employees to the extent prescribed by ORS 30.285 and 30.287. When an officer, agent
or employee receives notice of a tort claim or demand for which he/she may be entitled to defense
or indemnity, and that person files a written request for defense and indemnification through Risk
Services, it is my responsibility to accept or reject such requests, and to notify the employee and
Risk Services of my determination.
C. On March 22, 2011, I issued Administrative Order No. 21-11-01; delegating to the
City Attorney the authority to carry out my duties and responsibilities to accept or reject requests
for defense and indemnification.
D. In addition to the authority granted to the City Attorney by Administrative Order
No. 21-11-01, I find it would be more efficient and in the public interest to also grant to the
Executive Director of Central Services the authority to carry out my duties and responsibilities to
accept or reject requests for defense and indemnification.
NOW, THERFORE,
The City Manager of the City of Eugene Orders and Directs that:
1. The above findings are adopted.
2. The Executive Director of Central Services is authorized to carry out the following
duties with respect to employee requests for defense and indemnification:
a. Review Risk, Services' investigation, findings and recommendation
regarding requests for defense and indemnification;

b. Accept or reject requests in accordance with ORS 30.285 and 30.287; and
C. Notify requesting employees and Risk Services as to disposition of requests.
3. The delegation of authority contained in this Order shall be construed to extend to
and include any person(s) "acting in capacity" (AIC) for the Executive Director of Central
Services.
