REPEAL OF RULES FOR GOLDEN GARDENS PARK IN -WATER DOG
TRAINING PERMITS AND ADMINISTRATIVE ORDER NO. 58-13-07-F.
The Executive Director of the Public Works Department of the City of Eugene finds
as follows:
A. Section 2.019 of the Eugene Code, 1971, authorizes the City Manager to adopt rules
and regulations necessary for the administration or enforcement of provisions of the Eugene Code,
1971. Pursuant to the authority in Administrative Order No. 21-03-12 issued by the City Manager,
the Executive Director of the Public Works Department is authorized to regulate City parks, protect
park visitors and the park environment, and adopt rules regarding the use of parks.
B. On October 10, 2013, Administrative Order No. 58-13-07-F was issued adopting
Rules for Golden Gardens Park In -Water Dog Training Permits for the purpose of establishing a
formal permitting process and regulations for the in -water dog training activities taking place at
Golden Gardens Park.
C. On January 11, 2016, I issued Administrative Order No. 58-16-03, proposing to no
longer allow in -water dog training at Golden Gardens Park for the following reasons: (a)
participation in the program has declined significantly; (b) on-going impacts to wildlife are not
compatible with wildlife and habitat management goals for the site; (c) use by other park users
continues to increase creating greater opportunities for conflicts between users; and (d) changes in
staffing have eliminated resources to administer the program. In addition, as a result of my
proposal to no longer allowing the in -water dog training, I proposed to repeal Administrative Order
No. 58-13-07-F and the Rules for Golden Gardens Park In -Water Dog Training Permits.
D. Notice of the proposed repeal of the in -water dog training and the Rules for Golden
Gardens Park In -Water Dog Training Permits was given by making copies of the Notice attached
as Exhibit A to Administrative Order No. 58-16-03 available to any person who had requested
such notice, and by publication of the Notice in the Register Guard newspaper on January 14, 15,
16, 17 and 18, 2016. The Notice provided that written comments or objections to the proposed
Rule be submitted within 15 days of the first date of publication of the Notice. No comments were
received within the time or in the manner provided in the Notice.
Based upon the above findings which are adopted, and the findings in Administrative
Order No. 58-16-03, and pursuant to the authority contained in Section 2.019 of the Eugene Code,
1971, and Administrative Order No. 21-03-12, I order that in -water dog training at Golden Gardens
Administrative Order - Page 1 of 2
Park is no longer allowed, and Administrative Order No. 58-13-07-F establishing the Rules for
Golden Gardens Park in -water dog training permits is repealed.

Subject: Comment Regarding Administrative Order No. 58-16-03-F Repelling Rules for Gold n rdens
Park In -Water Dog Training Permits
Following a 15 -day public comment period, on February 3, 2016, I issued Administrative Order
No. 58-16-03-F which repealed Rules for Golden Gardens Park in -water dog training, and established that
in -water dog training no longer be allowed at Golden Gardens Park.
At the time that I signed Administrative Order No. 58-16-03-F, I had understood that no
comments had been received during the comment period, and indicated that in the Order. Since that time,
staff have become aware of a comment that had been received during the comment period, but had been
misplaced.
The comment was from Pete Goodale who wrote that his club had been maintaining the area for
30 years, while the City has done nothing. He indicated that he has never witnessed an incident that had a
negative impact on wildlife. He felt that dog training at the Park would be only a small inconvenience to
the City and suggested a 10 a.m. curfew Monday through Friday only.
I thank Mr. Goodale for his comments and the positive contributions he and others have made to
the Golden Gardens Park area over the years. The Park is changing and will be redesigned and
redeveloped to incorporate other uses, and discussions about those changes are underway. While the
City has not had any issues with Mr. Goodale and his dogs, it has had issues with other dog trainers in
recent years, with reported incidents between dogs being trained and other park users.
Although I understand Mr. Goodale's position, in -water dog training at Golden Gardens Park will
not be reinstituted at this time and, therefore, Administrative Order No. 58-16-03-F is reaffirmed.
