ADMINISTRATIVE ORDER NO. 58-07-08-F
of the
City Manager pro tern of the City of Eugene
INFLATIONARY ADJUSTMENT OF SYSTEMS DEVELOPMENT
CHARGES FOR REGIONAL WASTEWATER SYSTEM.
The City Manager pro tern of the City of Eugene finds as follows:
A. Section 2.020 of the Eugene Code, 1971 (EC), authorizes the City Manager of the
City of Eugene to determine and set fees and charges to be imposed by the City for services,
goods, use of municipal property, and licenses and permits. EC 7.71 O( 5) authorizes the City
Manager to adopt by administrative order changes to Systems Development Charge (SDC) rate
factors and cost indices.

B. The most recent amendments to the SDC Methodologies were adopted by
Resolution No. 4900 effective on May 7, 2007.
C. In accordance with the procedures set forth in EC 2.020 and 7.710(5), on July 23,
2007, the City Manager issued Administrative Order No. 58-07-08 and notified the Mayor and
City Council that he intended to amend Systems Development Charges for Regional Wastewater
System by implementing a 4.2% inflationary increase as set forth in the Notice attached as
Exhibit A to that Order. The increase was based on the recommendation of the Metropolitan
Wastewater Management Commission (MWMC), and the national 20-city average Construction
Cost Index as published by the Engineering News-Record.
D. Notice was also posted at two locations at City Hall and published in the Register-
Guard, a newspaper of general circulation within the City, on July 27, 2007. In addition, Notice
was made available to persons who requested such notice, and for inspection by interested
persons at the office of the City Engineer, Public Works Department, 858 Pearl Street, Eugene,
Oregon 97401, during normal business hours (8:00 a.m. to 5:00 p.m., Monday through Friday,
exclusive of holidays). Notice provided that written comments would be received for a period of
15 days from the date of posting and publication. No comments were received within the time or
in the manner set forth in the Notice.
E. After considering the applicable policies, enactments and directives of the City
Council, the amount charged for these services by the City in the past, the full costs of providing
these services supported by the fees, the amounts charged by other comparable providers, and the
revenue needs of the City as determined by the adopted City budget, I find that the inflationary
adjustments to the Systems Development Charges for Regional Wastewater System are
consistent with adopted policies of the City, in conformity with applicable state law, authorized
by EC 7.71 O( 5), and should be implemented as proposed effective August 20, 2007.
On the basis of these findings, I order that:

1. The adjusted Systems Development Charges for Regional Wastewater System as
set forth in the attached Exhibit A are to be implemented effective August 20, 2007.
2. The unamended City of Eugene Systems Development Charge Methodologies
shall remain in full force and effect.
3. A copy of this Administrative Order shall be appended to the System
Development Charge Methodologies adopted by Resolution No. 4900.
