ISSUE STATEMENT
The City Council is requested to approve the sale of approximately a 987 square feet of City owned
property fronting on Hilyard Street. This is a surplus portion of a parcel acquired for the Courthouse
Road Improvement Project. The majority of the site is being dedicated as public right-of-way.
BACKGROUND
The City has a remnant parcel of vacant land which remains from a larger area the City purchased for
the reconstruction of Highway 99/Hilyard Street from the present Broadway route to the planned
Hilyard route. The 987 square foot area of the subject property is proposed to be sold to the adjacent
property owner to the south (tax lot 300 on Assessor’s map 17-03-32-23). The subject remnant parcel
does not meet minimum lot size standards per the City Code and is not a buildable lot. The subject
surplus property is a portion of tax lots 100 and 200 of map 17-03-32-23. The remainder of tax lots 100
and 200 will be retained by the City and will be dedicated by a Street Deed as public right-of-way prior
to the proposed sale.
In the design of the proposed relocation of Highway 99, for safety standards some of the access to the
adjacent property owned by the Chens is being eliminated, which in turn results in the loss of two or
three parking spaces on their restaurant property. The Chen’s property is the site of Daniel’s Restaurant
on the northwest corner of Broadway and Hilyard streets. The adjacent property owner has requested
that the City sell the subject surplus property to replace the parking spaces and to gain shared access
from the proposed access to McDonald’s Restaurant from Hilyard. The adjacent property owner has
agreed to pay the City the amount equal to the City’s cost to purchase the area for the road project of
about $21.07 per square foot or $20,796 for the 987 square feet. The subject area is not needed by the
City of Eugene. Only the surplus area outside of the roadway, sidewalk, and landscaping area is
proposed to be sold. The reserved area is considered to be adequate to serve the City’s needs for the
foreseeable future.
City Transportation staff are supportive of the sale. No negative impacts are noted to utilities, police, or
fire.

COUNCIL OPTIONS
The council has the option to either accept or reject the proposed sale to Michael Chen and Kitty Chen.
If the council concurs to the proposed sale and terms, it may consummate the transaction consistent with
Eugene Code 2.872 which states “a proposal acceptable to the City Manager shall be presented to
council for its action.”
If the council chooses to reject the proposed sale, it may elect to renegotiate modifications to the
proposed sale terms or choose to retain ownership of the present city owned remnant parcel.
CITY MANAGER’S RECOMMENDATION
The City Manager recommends that the council direct the City Manager to proceed with the sale of the
subject remnant parcel to the adjacent property owners, Michael Chen and Kitty Chen for the amount of
$20,796.
SUGGESTED MOTION
Move to authorize the City Manager to consummate the sale of the City owned 987 square feet for
$20,796.
