ISSUE STATEMENT
This public hearing is on a proposal for a refinement plan amendment, code amendment and zone
change for property owned by Western Steel Inc. and MVMM Edwards Investment LLC. The subject
site is a 4.14-acre site, comprised of two parcels in the Summer Oaks-Crescent Center subdivision, and
is located east of Coburg Road, on the south side of Crescent Avenue, east of Suzanne Way. The
applicant requests a change to the current Willakenzie Area Plan land use diagram from Neighborhood
Commercial/Nodal Development to Community Commercial/Nodal Development; to amend the
Willakenzie Area Plan text to provide new policy language supporting the Community Commercial
designation, limiting the number of vehicular trips per day to the site and reducing the required Floor
Area Ratio for the subject site; to amend the Eugene Land Use Code 9.9700 to incorporate amended
policy language in the Willakenzie Area Plan; and to change to the existing zoning from C-1/SR/ND
Neighborhood Commercial with Site Review and Nodal Development overlay zones, to C-2/SR/ND
Community Commercial with Site Review and Nodal Development overlay zones. This request does
not include a development proposal.
BACKGROUND
The City of Eugene Planning Commission held a pubic hearing on August 14, 2007, to consider the
requested refinement plan amendment, code amendment and zone change. Following the close of the
public hearing, the Planning Commission left the public hearing record open for new evidence and
testimony by August 22, 2007, and any rebuttal comments from the applicant by August 29, 2007.
Subsequently, on September 17, 2007, the Planning Commission met for deliberations and voted four to
one to recommend approval of the requests to the City Council. The Planning Commission’s findings,
which provide a detailed analysis of the proposal relative to the applicable approval criteria, are attached
as Exhibit A to Attachment A. No letters of public testimony, other than testimony provided by the
applicant’s representative, have been received to-date.
The refinement plan amendment request includes a change of policy language which, if approved, must
also be incorporated into the land use code through a code amendment process. Pursuant to Eugene
Code (EC) Section 9.7510, code amendments can only be initiated by the City Council. On May 29,
2007, the City Council voted to initiate this code amendment requesting changes to the Willakenzie
Area Plan policy language in Eugene Code (EC) Section 9.9700(10), authorizing the applicant to
proceed with the land use process.
The proposed zone change is being reviewed concurrently with the proposed refinement plan
amendment. Pursuant to EC 9.7305, when the City considers a zone change concurrently with a
refinement amendment, the City is to use the applicable procedures for the Metro Plan amendment. In
regards to process, the refinement plan and zone change requests must follow the quasi-judicial
procedures. New evidence will be allowed at the public hearing.
RELATED CITY POLICIES
Eugene Code requires that a refinement plan amendment and code amendment be consistent with the
Metro Plan, the applicable refinement plan, as well as the Statewide Planning Goals. The Metro Plan
and Willakenzie Area Plan policies applicable to this request are addressed in the attached findings.

COUNCIL OPTIONS
After holding the public hearing, the City Council may:
1.As recommended by the Planning Commission: Approve the Willakenzie Area Plan amendment,
code amendment and zone change by approving the draft ordinance and findings;
2.Approve the Willakenzie Area Plan amendment, code amendment and zone change with modified
findings; or
3.Deny the Willakenzie Area Plan amendment, code amendment and zone change based on conflicts
with Statewide Goals, Metro Plan, or refinement plan policies.
City Council action on this item is currently scheduled for November 13, 2007.
CITY MANAGER’S RECOMMENDATION
The City Manager recommends that the City Council conduct the public hearing and, based on the
information in the record at this time, the City Manager would recommend the council adopt the
Planning Commission recommendation that the requests comply with all applicable approval criteria,
and that the Willakenzie Area Plan amendment, code amendment and zone change be approved.
Additional analysis on any new information and a final recommendation will be included in the council
packet for the November 13, 2007, deliberation.
SUGGESTED MOTION
No motion is suggested as action is currently scheduled for November 13, 2007.
