ISSUE STATEMENT
This is a public hearing on a proposed ordinance to revise the Eugene Code to comply with new federal
guidelines for air quality. The original request for this compliance comes from the Lane Regional Air
Protection Agency, (LRAPA).
BACKGROUND
At the City Council work session of October 8, 2007, Councilor Taylor, the City’s elected official on the
LRAPA Board, delivered a written request from LRAPA requesting the City of Eugene to amend its
code to comply with new air quality standards. These changes are recommended as a result of the United
States Environmental Protection Agency’s (EPA) revision to air quality standards.
On November 1, 2007, in the weekly informational packets provided to each member of the City
Council, a memorandum and background materials offering more detail on the requested revisions to the
Eugene Code were provided. That memorandum was provided in lieu of a council work session as the
proposed ordinance represents a fairly simple change to the Eugene Code.
This section of the code was last amended in 2002, to lower the acceptable particulate matter based upon
the actions of the EPA. A copy of that ordinance is also attached.
RELATED CITY POLICIES
This is related to the City Council goal on sustainable development: A community that meets its present
environmental, economic, and social needs without compromising the ability of future generations to
meet their own needs.
COUNCIL OPTIONS
This is a pubic hearing on the proposed ordinance. The City Council can, however, suggest
amendments to the proposed ordinance at this time.

AN ORDINANCE CONCERNING SOLID FUEL SPACE
HEATING DEVICES, AND AMENDING SECTION 6.250 OF
THE EUGENE CODE, 1971.
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1.
The definitions of “Green advisory,” “Stage I red advisory,” “Stage II
red advisory,” and “Yellow advisory” set forth in Section 6.250 of the Eugene Code,
1971, are amended as follows:
6.250 Solid Fuel Space Heating Devices - Definitions
. As used in sections
6.255 to 6.265, the following words and phrases mean:
Green advisory
. A 24-hour period beginning at 4:00 p.m. when PM10 levels
are forecast by LRAPA to be less than 100 micrograms per cubic meter and
PM2.5 levels are forecast to be less than [41] 25 micrograms per cubic
meter.
Stage I red advisory
. A 24-hour period beginning at 4:00 p.m. when PM10
levels are forecast by LRAPA to be greater than or equal to 125 micrograms
per cubic meter but less than 150 micrograms per cubic meter, or when
PM2.5 levels are forecast by LRAPA to be greater than or equal to [55] 30
micrograms per cubic meter but less than [65] 35 micrograms per cubic
meter, within the Eugene-Springfield Metropolitan Area General Plan Urban
Growth Boundary.
Stage II red advisory
. A 24-hour period beginning at 4:00 p.m. when PM10
levels are forecast by LRAPA to be greater than or equal to 150 micrograms
per cubic meter, or when PM2.5 levels are forecast by LRAPA to be greater
than or equal to [65] 35 micrograms per cubic meter, within the Eugene-
Springfield Metropolitan Area General Plan Urban Growth Boundary.
Yellow advisory
. A 24-hour period beginning at 4:00 p.m. when PM10
levels are forecast by LRAPA to be greater than or equal to 100 micrograms
per cubic meter but less than 125 micrograms per cubic meter, or when
PM2.5 levels are forecast to be greater than or equal to [41] 25 micrograms
per cubic meter but less than [55] 30 micrograms per cubic meter.

Section 2.
The City Recorder, at the request of, or with the concurrence of the
City Attorney, is authorized to administratively correct any reference errors contained
herein or in other provisions of the Eugene Code, 1971, to the provisions added,
amended or repealed herein.
