Candidate Application Packet
Eugene City Council and Eugene Water & Electric Board
Applications are being accepted for the positions of Eugene City Councilor and Eugene Water & Electric
Board (EWES). These positions will be voted on in the May 20, 2008, Primary Election. Filing deadline is 5
p.m., March 6, 2008.
The May Primary Election is a qualifying election. If a candidate wins more than 500/0 of the total vote for that
position, only that candidate's name will be placed on the November 4, 2008, General Election ballot If no
candidate receives more than 500/0 of the vote, the names of the two candidates receiving the most votes in
the May primary will be placed on the November ballot.
The Eugene City Recorder is the Elections Filing Officer for the City of Eugene and Eugene Water & Electric
Board elections. Please call in advance to schedule an appointment with the City Recorder to submit
your preliminary forms (541-682-5042).

Qualifications 'and Residency Requirements
. Any person holding elective office must be a registered voter in the State of Oregon.
. Any person elected to office must have been a legal resident of the city of Eugene for at least one
year prior to being elected in the November 4, 2008, General Election.
. The Mayor must reside within the legal boundaries of the city of Eugene.
. City Council candidates must reside in the ward they seek to represent.
. Eugene Water & Electric Board (EWES) candidates must reside in one of the two wards they seek to
represent. The candidate for the at-large position must reside in Eugene.
Eugene City Code, Section 2.965, defines residency: IIA candidate for a city office must have been a
resident of the city for at least one year immediately preceding the election that results in election to the office,
and shall maintain his or her residence within the city and the area he or she seeks to represent at the time of
nomination and throughout his or her term of office if elected. Removal of an officer's residence from the city
or from the area he or she represents shall create a vacancy in the office for which elected, to be filled in the
manner other vacancieS in that office are filled. If a councilor or candidate has more than one residence, then
the requirements of this section apply to the principal place of residency, which is the residence where the
person spends more than 500/0 of the time."

Step 1: File Prospective Petition
Complete the three forms listed below and submit them to the City Recorder for approval prior to
gathering any signatures and well in advance of the March 6 filing deadline. No filing fees are
required to run for City of Eugene offices.

Prospective candidates must file the following forms with the Oregon Secretary of State Elections
Division:
SEL 220 Candidate's Statement of Organization
SEL 223 Campaign Account Information
These forms are not required if the candidate acts as his or her own treasurer and expects to spend
or receive less than $300 during the entire calendar year. See the Candidate 'Quick Guide' on
Campaign Finance Reporting in Oregon included in this packet.
The filing must occur within three business days of receiving the first contribution or making an initial
expenditure. These filings can be done electronically at www.oreaonvotes.ora. At this website, you
may log in and register in the OreStar system to receive additional instructions. For more information,

Step 3: Collect Sionatures
Upon approval of the prospective petition, the City Recorder will give the candidate a letter
authorizing the collection of signatures. This letter must be submitted to Lane County Elections when
signature gathering is complete.
Mayoral, City Council, and EWES candidates must submit at least 25 nominating signatures of
registered voters who reside within the jurisdiction they seek to represent.
Candidates should collect additional signatures in the event that some are disqualified.
Oregon law requires that each petition sheet be property certified by its circulator, who must
personally witness each signature.
Step 4: File Completed Petition
The signature sheets with the authorization letter must be submitted by the candidate to Lane County
Elections Division at 275 W. 10th Avenue, Eugene, OR 97401 for verification of sufficiency and
validity (541-682-4234).
Lane County Elections will contact the candidate when signature verification is completed. The
candidate needs to pick up the signature sheets from the elections division.
The candidate must submit to the City RecorderJs Office a "completed" petition (SEL 120), along with
the certified signature sheets no later than 5 p.m., March 6, 2008.
Campaig'" Finance Reportin-g Requirements
Please review the Campaign Finance Manual for instructions and a filing schedule. Campaign finance forms
are filed electronically with the Secretary of State's Elections Division.
All candidates who receive or spend more than $300 during the calendar year are required to establish a
dedicated campaign bank account. Those who do not expect to receive or spend more than $2,000 during the
year may file a "Certificate of Limited Contributions and Expenditures (PC7). Candidates who will exceed the
$2,000 limit must file detailed contribution and expenditure reports.

All persons holding office in the City of Eugene, including the Eugene Water & Electric Board, are required to
file Statements of Economic Interest with the Oregon Government Ethics Commission (formerly the Oregon
Government Standards and Practices Commission). The annual reports must be filed by April 15 every year
of the incumbency of the elected official. In addition, quarterly reports will be due January 15, April 15, July
15, and October 15, beginning in April, 2008. Information will be requested concerning sources of income,
property, business interests and gifts related to the office. Civil penalties may be imposed for failure to file, or
for insufficient information. Oregon Administrative Rules with details about the new reporting requirements will
be available in early 2008. Please contact the City Recorder's Office for additional information.

Conflict of Interest
Please note that Section 14 of the Eugene City Charter specifically addresses ethics and conflict of interest
for elected officials. Please contact the City Recorder's Office for additional information or the Charter may be
viewed online by going to the City Hall, City Recorder's website at www.euaene-or.aov.
Voluntary Campaign'- Finance Spending Limits
In April 2002, the City Council adopted Resolution Number 4709, creating a voluntary campaign finance
program for City elections. The program seeks to improve the City election process by encouraging
candidates for City offices to limit campaign expenditures and contributions. The program is voluntary and is
limited to candidates who pledge that they will comply with all the expenditure and contribution limits. For City
Council elections, the voluntary expenditure limit is $7,500; for the Mayoral election, the voluntary expenditure

limit is $30,000. Contribution limits for council elections are $100 per person and $500 from the candidate; for
the mayoral election they are $500 per person and $500 from the candidate.
The program is entirely voluntary~ The names of those candidates who pledge to limit contributions and
expenditures within the scope of the program and adhere to those limits throughout the entire campaign will
be published in the local newspaper and on the City's website. The state-required contribution and
expenditure reports will be used to determine expenditures and contributions. For additional information, see
Resolution 4709.
Voters' Pamphlet
· Mayor and City Council candidates have the opportunity to place an argument in support of their
candidacy in either the City or State Voters' Pamphlet. Additional information concerning cost,
requirements, and filing deadlines will be available from the City Recorder's Office in early 2008.
. EWES candidates may also participate in the City of Eugene Voters' Pamphlet, if one is produced.
EWES candidates are not included in the State Voters' Pamphlet.
. Please note that the City only produces a voters' pamphlet when Eugene measures are on the ballot.
Sign Regulations
Eugene Code 9.6610 regulates the types and placement of Election signs:
. Signs 12 square feet or less in area are allowed on private property during the period from 60 days
before to five days after any public election to be held in Lane County, Oregon.
. Signs may be placed on private property only with the permission of the owner (including for use of
private, vacant lots).
. No signs are allowed in the public right-of-way; e.g., on lamp posts or bridge approaches, median
strip between lanes of traffic, grassy strip between the sidewalk and street, any publicly owned
property. Signs my not hide from view any traffic control device.

The following information for city candidates is
provided in the order in which the activities generally
occur and includes explanations and time frames
for each activity.
For city offices, city charter or ordinance
requirements may differ from state statutes.
For more information and specific
requirements, contact the city elections official
before filing.
All Candidates for City Office
Qualifications for various city offices differ. Before filing
for public office, a candidate should review the city
charter and statutory requirements for the office sought.
Candidates for city offices file under
ORS Chapters 221 and 249.

Candidates Filing by Petition
. A candidate may have only one candidate
committee. A prospective candidate establishes a
candidate committee by opening a campaign account
and filing a Statement of Organization for
Candidate Committee (SEL 220) and Campaign
Account Information form (SEL 223) with the Secretary
of State, Elections Division.
The candidate is not required to establish a campaign
account, file a Statement of Organization or file
contribution and expenditure transactions, if all three
of the following conditions are met:
--+ the candidate serves as the candidate's own treasurer
~ the candidate does not have an existing candidate
committee
and
-+ the candidate does not expect to receive or spend
more than $300 during a calendar year
However, if at any time the candidate exceeds $300
in either contributions or expenditures, the
candidate must open a campaign account, file a State-
ment of Organization and within seven calendar days
of exceeding the threshold, electronically file all con-
tributions received and expenditures made during the
calendar year. The $300 includes personal funds spent
for any campaign-related costs, such as expenses
incurred in circulating a nominating petition, paying a
Voters' Pamphlet filing fee or cost for Voters' Pamphlet
portrait.
If the candidate has an existing candidate committee,
the candidate or treasurer must file an amended
Statement of Organization for Candidate Committee
(SEL 220) within 10 days of changing any information
on the Statement of Organization, but no later than
the date of the filing of candidacy. The amendment wiU
reflect any changes (designation of office sought,
applicable election, etc.)

Before circulating the nominating petition, the
candidate files a prospective petition with the city
elections official.

Below is a checklist of all the components required
to file a prospective nominating petition:

City Elections Official
As soon as possible, the city elections official
reviews the prospective petition for required
information. The city elections official gives written
approval for circulating the petition and advises
the candidate of the number of signatures required.
o
Candidate Filing By Petition
Before circulating the nominating petition for
signatures, the candidate reviews with the
circulators all of the guidelines for circulating the
petition. Failure to comply with the legal
requirements and guidelines will result in the
rejection of these sheets. The guidelines are:
~ all signers must be active registered voters in the
candidate's electoral district
~ all signers on anyone petition sheet must be
registered in the same county
~ all signatures must be original signatures
~ all signatures must be personally witnessed by the
petition circulator and circulator's certification
must be completed and dated after all signatures on
that sheet have been collected
~ circulators must not attempt to obtain
signatures of persons knowing that the person
signing the petition is not qualified to sign it
-+ circulators must personally sign their legal signature
on the petition circulator's certification with a
minimum of a first name initial and full last name
~ circulators must not alter, correct, clarify or obscure
on the signature sheet any information about the
petition signer unless the signer initials the changes
made. Only a signer may complete the information
about themselves, such as their printed name, address
and date signed. However, a circulator may assist a
disabled signer who requests assistance in completing
the optional information
~ circulators must not accept compensation to
circulate a petition that is based on the number of
signatures obtained
and
-+circulators must complete the date when the
certification is signed and should not collect any
other signatures on that sheet unless the additional
signatures are certified

number of valid signatures

county elections official for signature verification
A candidate must allow enough time to have the
signatures verified before the filing deadline.
The county elections official reviews signature sheets
for sufficient circulator certification (see OAR 165-014-
0270, page 67), verifies the original signatures against
the voters' current registration card and returns the
certified signature sheets to the candidate. The county
may confer with the Secretary of State on the proper
application of this rule.

General Information
The following information gives a general overview
of other procedures relating to candidates filing
for office, including submitting a Voters' Pamphlet
statement, withdrawal of candidacy, contribution
and expenditure reporting, conduct of elections and
signature sheet requirements.
State Voters' Pamphlet
(ORS Chapter 251)
A candidate of a city with a population of 50,000 or
more may file a statement for inclusion in the
state Voters' Pamphlet if no countyVoters' Pamphlet is
published. Counties may publish a countyVoters'
Pamphlet for any election. Contact the county elections
official for filing information and requirements.
Secretary of State
The Elections Division publishes
and distributes the state Voters' Pamphlet.
Published candidate information includes:
~ candidate's photograph
~ office for which candidate has filed
-7 candidate's name and party affiliation, if applicable
-+ candidate's required information (occupation,
occupational background, educational background
and prior governmental experience)
-+ candidate's optional information (the candidate's
statement of the reasons for seeking nomination
or election)
and
~ name of the candidate or the candidate committee that
provided the information
Checklist for Filing a Statement in the
State Voters' Pamphlet
Below is a checklist of all the components required
to file a state Voters' Pamphlet statement:
o one original and two identical copies
(for a total of three) of Candidate's Statement for State
Voters' Pamphlet (SEL 430)
o a Statement of Endorsement (SEL 400), if the candidate's
statement uses the name or title of another person
or organization as supporting or endorsing the candidate.
A separate Statement of Endorsement must be filed
for each person or organization named, unless the
statement of the person or organization is a quotation,
identified by source and date, which has been
previously published.
o phone numbers and fax numbers, if available,
for possible contact by the Elections Division for any
corrections
o appropriate Voters' Pamphlet filing fee
o two identical 5" x 7" black and white
photographs meeting the requirements listed on form
SEL 430 (ORS 251.075)
Withdrawal of Candidacy or
Nomination (ORS 249.170 and
249.180)
All Candidates
To withdraw from candidacy or nomination,
a candidate must file a Withdrawal of
Candidacy or Nomination (SEL 150), with the city
elections official. On this form, the candidate provides
a reason for the withdrawal and must sign the form
attesting that the information is accurate.
Contribution and Expenditure
Reporting (ORS Chapter 260)

All Candidates
Every candidate and prospective candidate is required
to establish a candidate committee by opening a
campaign account and filing a Statement of Organization
(SEL 220) and Campaign Account Information form
(SEL 223) within 3 business days of receiving or spending
any money to support the candidate.
The candidate is not required to establish a campaign
account, file a Statement of Organization or file
contribution and expenditure transactions, if all three
of the following conditions are met:
-+ the candidate serves as the candidate's own treasurer
-+the candidate does not have an existing candidate
committee
and
-+ the candidate does not expect to receive or spend
more that $300 for the entire election
However, if at any time the candidate exceeds $300 in
either contributions or expenditures, the candidate
must establish a campaign account, file a Statement
of Organization and within seven calendar days of
exceeding the threshold, electronically file all contribu-
tions received and expenditures made during the
calendar year.The $300 includes personal funds spent
by the candidate or treasurer for any campaign-
related costs, such as any costs related to circulating a
nominating petition, paying the candidate filing fee,
paying anyVoters' Pamphlet filing fee or cost of a Voters'
Pamphlet portrait.
All city candidates file their Statement of Organization
and contribution and expenditure transactions with the
Secretary of State, Elections Division. A city candidate
should check with their city as it may adopt ordinances
that require a committee to also file campaign finance
transactions with the city.

A candidate or the candidate's treasurer files contribu-
tion and expenditure transactions for the calendar year.
JlCandidate" includes any of the following:
-+ a candidate who files for office
-+ a candidate who withdraws or is disqualified
~ an individual who files a prospective petition for

Oregon election law requires all candidates or their
candidate committees to disclose timely and accurate
contribution and expenditure transactions. All candidates
and committees must maintain detailed records
of all contributions received and expenditures made.
All campaign finance transactions must be filed
electronically using the Secretary of State's online filing
system, ORESTAR, or by using vendor software to
upload transactions. In addition, the statute provides
for civil penalties up to $10,000 for fi ling any late or
insufficient transactions.

A candidate or committee that does not expect to
receive or spend more than $2,000 in a calendar year
to support a candidacy may qualify to file a Certificate
of Limited Contributions and Expenditures (PC 7).
See 2008 Campaign Finance Manual for information on
who is eligible to file a certificate (PC 7).
The candidate and treasurer are jointly responsible
for the committee and for filing contribution and
expenditure transacti ons. If the treasurer violates any
campaign finance regulations, the candidate is also
in violation and is jointly liable for any civil penalties.

ORESTAR User Manual. ORESTAR (Oregon Elections
System for Tracking and Reporting) is the Secretary
of State, Elections Division's secure, web-based elec-

All signature sheets must be approved, in writing,
by the city elections official before circulating.
Failure to do so will result in the rejection of those
signature sheets.

Each signature line must include fields for:

Signers are required to provide a signature and
residence or mailing address. However, an elector's
printed name, the date they signed the petition and
precinct number are not mandatory under Oregon law.
These information fields, while optional for the signers,
provide valuable assistance to county elections of-
ficials who perform the signature verification. If these
optional fields are not completed, the signatures may
still be submitted for signature verification.
If the county elections official can determine from
the signature alone that the elector was an
active registered voter at the time the elector signed
the petition, that signature will count toward
the total signature requirementforthe petition. If no
date is provided by the elector, the signature is
considered valid only if the county elections official
determines that the elector was an active
registered voter during the period beginning the date
the petition was approved for circulation through
the petition is filed for signature verification.

Signature Sheet Format
Candidate signature sheets must meet the following
formatting requirements:

-+ at least 20 pound (weight) uncoated paper

-+ printed on white or pastel colored paper stock to
render text readable and enable election officials to
readily verify signatures

approved in writing by the city elections official.

Electors' signatures on candidate nominating
petitions must be verified by the appropriate county
elections official before filing the candidate's
completed petition with the city elections official.
Signers must meet all of the following

registered voters in the same county
-+ each signer must be an active registered voter of
the candidate's electoral district at the time of signing
the petition
and
~ each signer must provide a signature and
residence or mailing address
Circulator Requirements
(ORS 249.061)
The circulator of the candidate nominating petition
must sign the circulator's certification, stating that:
~II hereby certify that I witnessed the signing of the
signature sheet by each individual whose signature
appears on the signature sheet, and I believe each
individual is an elector qualified to sign the petition. I
also certify that compensation I received, if any, was
not based on the number of signatures obtained for
this petition."
Circulators must not alter, correct, clarify or obscure
on the signature sheet any information about the
petition signer unless the signer initials the changes
made. Only a signer may complete the information
about themselves, such as their printed name, address
and date signed. However, a circulator may assist a
disabled signer who requests assistance in completing
the optional information.
The circulator must complete the date when the
certification is signed and should not collect any
other signatures on that sheet unless the additional
signatures are certified.

lating the petition listed on page 13.

Certification of Signature Sheets
(OAR 165-014-0270)
While processing signature sheets submitted
for verification the county and city elections officials
confirm that each signature sheet has a sufficient
circulator certification. The following criteria
(as adopted in OAR 165-014-0270, pages 68-69) are
used to determine what constitutes an insufficient
or sufficient circulator certification.
Insufficient Circulator Certification
A petition sheet will be rejected for
insufficient circulator certification for any of the
following reasons:
~ no signature whatsoever appears below the
certification
-+ no date appears next to circulator's signature or the
date is crossed out
-+ the date of the circulator certification is earlier than
the date of the electors' signatures, unless the
circulator and the only signer are the same person
-+ the original date is crossed out, and a new date is
provided, but the circulator failed to re-sign
--y any part of the original date is overwritten with a
different date
~ the date information is insufficient or ambiguous
The date must be provided in month, day, year order if
written in all numeric characters.
-+ the original signature of a circulator has been crossed
out, and a different circulator's signature is inserted
-+ two individuals sign and date as circulator, unless the
only signers and the circulators are the same people
--+ white-out appears on the signature or date line
~ the circulator has signed using only initials, unless
the circulator's use of initials as a signature is verified
by exemplar
.....the circulator has signed using a signature stamp,

copied, or otherwise appears on the face of
the document to be a replicated and not an original
signature except as provided for in ORS 250.043

verified by exemplar

If a preliminary determination is made that a
certification is insufficient, the certification
signature may be verified by exemplar. For correct
procedures on filing an exemplar, refer
to OAR 165-014-0270 located on pages 68-69.
Sufficient Circulator Certification
The following defects in the circulator certification will
not result in rejection of the signature sheet:

Signature and Distribution
Requirements (ORS 249.072)
Generally, the number of active registered voters'
signatures required to place a candidate on the
ballot is based upon a percentage of voters registered
in the electoral district or upon a percentage of votes
cast at a previous election. Confer with the city
elections official for specific requirements.
Unless a city charter or ordinance provides otherwise,
the number of signatures of active voters registered
in the electoral district must equal the lesser of 500
signatures or 1% of the votes cast in the electoral dis-
trict for all candidates for Governor at the last general
election at which a candidate for Governor was elected
to a full term. This number will be calculated after the
prospective petition is filed.
The signatures must include those of active
voters registered in each of at least 10% of the
precincts in the city.
Guidelines for Required Information
on SEL 120 (GRS 249.031)
On the Filing of Candidacy for Nonpartisan Nomination
form, SEL 120, the information in the fields for
lIoccupation;' 'Ioccupational background;' lIeducational
background" and IIprior governmental experience"
are required and must be accurate. The statements
made in these fields are subjectto ORS 260.715(1),
which states, II No person shall knowingly make a false
statement, oath or affidavit where a statement, oath
or affidavit is required under the election lawsa" A false
statement may be enforced as a Class C Felony.
The purpose of these guidelines is to assist the candidate
in completing the required fields. A variation not
addressed here does not necessarily indicate an election
law violation. The main principle is that all information
provided is accurate and can be substantiated by the
candidate should a complaint be filed.
The following are some suggestions for complet-
ing the Occupation category:
-+ Include current full or part-time employment or other
line of work, business, craft or professional information
(not required to indicate whether paid or unpaid).
-+ There is no required amount of time spent at an
occupation in order to include it.
-+ It is not required that every occupational experience is
included, but what is listed must be accurate.
-+ If there is no relevant information, the candidate must
at least list "None," although it is advisable to provide
a description such as, I'retired," "unemployed,"
IIstudent," IIhomemaker," etc.
~ It is advisable to convey the nature of the work
performed rather than only a generic description (such
as, "self-employed writer," rather than only
IIself-employed" or IIGrocery Store Manager," rather

A Statement of Organization (SEL 220), Campaign Account Information (SEL 223) and Certifi-

Contributions and expenditures must be reported electronically. You may want to check with
your local library or other public facilities in your area to see if they provide a computer terminal
for public use.
Must I have a dedicated
campaign account?
Oregon law requires that you establish a dedicated campaign account if you expect to spend or
receive more than $300 during the calendar year. The account must be established in a financial
institution located in Oregon that ordinarily conducts business, with the general public in Oregon.
One important reminder-when establishing your campaign account, the name of the
committee and the name of the account must be the same.
Are there limits on
campaign contributions
and expenditures?
Oregon does not have contribution and expenditure limits.
When do I report contribu-
tion and expenditures?
Contributions and expenditures are reported on a transaction-basis. Generally, a transaction is
due no later than 30 calendar days after the date of the transaction. For committees active in
an election, these dates will change. The campaign finance reporting requirements and additional

2.960 Elections - State Law. City elections, insofar as not governed by the city
charter or by special ordinances or other sections of this Code, shall be
conducted in accordance with the state law governing popular elections.

2.962 Elections - Wards. The city council shall by resolution divide the city into
eight wards but neither this requirement nor any action pursuant to it
disqualifies, or shortens the term of office of, a member of the councilor the
Eugene Water & Electric Board.

2.964 Elections - Nomination.
(1) A candidate for a city council office representing a particular ward shall
be nominated by the individual electors from that ward.
(2) A candidate for a Eugene Water & Electric Board office representing a
pair of wards shall be nominated by individual electors from those
wards.
(3) A candidate for the office of mayor or an office on the Eugene Water &
Electric Board representing the city at large shall be nominated by
individual electors from the entire city.
(4) In a year for filling an office referred to in subsection (1), (2), or (3) of
this section, a nomination of a candidate for the office shall be
conducted in accordance with the state law governing popular elections,
except that the nominating petition shall be filed with the city recorder at
least 75 days before the first election for filling the office and it shall be
signed by 25 legally qualified electors in the area to be represented by
the office. For purposes of calculating the filing deadline, the date of the
election shall be included in the computation of time.

Elections - Residencv. A candidate for a city office must be a legal elector
under the laws and constitution of the state and must have been a resident
of the city for at least one year immediately preceding the election that
results in election to the office, and shall maintain his or her residence within
the city and the area he or she seeks to represent at the time of nomination
and throughout his or her term of office if elected. Removal of an officer's
residence from the city or from the area he or she represents shall create a
vacancy in the office for which elected, to be filled in the manner other
vacancies in that office are filled. If a councilor or candidate has more than
one residence, then the requirements of this section apply to the principal
place of residency, which is the residence where the person spends more

2.966 Elections - Officers.
(1) In 2002 and every fourth year thereafter a councilor shall be elected
from each of the following wards:
(a) Ward 3.
(b) Ward 4.
(c) Ward 5.
(d) Ward 6.
(2) In 2004 and every fourth year thereafter a mayor shall be elected from
the city at large and a councilor shall be elected from each of the
following wards:
(a) Ward 1.
(b) Ward 2.
(c) Ward 7.
(d) Ward 8.
(3) In 1978 and every fourth year thereafter two members shall be elected
to the Eugene Water & Electric Board, one from wards 4 and 5 and one
from the city at large. In 1980 and every fourth year thereafter, three
members shall be elected to the board, one from wards 1 and 8, one
from wards 2 and 3, and one from wards 6 and 7.
(4) The first voting for mayor, councilor, or EWES member during a year
shall take place at an election held at the same time and places in the
city as the statewide primary election that year.
(5) If at the primary election one candidate for a city office receives a
majority of the votes cast for all candidates for that office, that candidate
shall be the only one whose name appears on the ballot for the
November election that year as a candidate for that particular office.
(6) If at the primary election no such candidate receives such a majority,
the two candidates receiving the two highest numbers of votes cast for
the office shall be the only ones whose names appear on the ballot for
the November election that year as candidates for that particular office.
(7) The candidate who receives a majority of the votes cast at the
November election for the office is elected to that office and is entitled
to a certificate of election thereto.
(8) A candidate who has been elected to office at the November election
shall take office upon the later of:
(a) Filing of the oath or affirmation of office; or
(b) The first Monday in January following the election.

Eugene Code
(1) Each member elected to the board before 1976 has the term of office
thereon for which so elected. Except as subsection (2) of this section
provides to the contrary, each member elected to the board during or
after 1976 has a term of office thereon of four years.
(2) The board may fill a vacant office thereon by appointing thereto a
person from the same constituency as the member who has last
occupied that office. If that member leaves the office vacant less than
14 months after the member's term on the board begins, at the next
primary and general November elections after the vacancy occurs, a
member shall be elected to the vacant office from the same
constituency as the member who has last occupied that office. The
term of office of the person so elected begins the first of the
immediately ensuing year and continues for two years.

January 18, 1978; and administratively amended by Ordinance No. 20113, enacted April 6,

Elections - Initiative and Referendum. Preamble and Definitions. The
initiative and referendum powers of the city and its electors shall be
exercised in accordance with sections 2.971 to 2.988 of this code and not
otherwise. State statutes governing exercise of the initiative and referendum
do not apply to exercise of these powers by the city or its electors. As used
in sections 2.971 to 2.988 of this code, the following words and phrases
mean:
City attorney. A person or law firm appointed by the city manager to provide
legal advice to the manager and council on election matters.
City office. The office of mayor, city councilor or Eugene Water and Electric
Board member
City recorder. The city manager or the manager's designee.
Completed petition. An initiative or referendum petition containing all of the
information required by law and containing at least the number of elector
signatures required by section 2.972 of this code.
Conflicting measures. Measures are conflicting when any part of one
measure cannot operate concurrently with a provision of the other measure
or when one or both measures expressly provide that they are intended to be
the exclusive enactment for that area of legislation.
Elector. A resident of the city qualified to vote under Oregon Constitution,
Article II, Section 2.
Initiative petition. A petition by one or more qualified electors to initiate
proposed legislation to be adopted at an election.

VOLUNTARY CAMPAIGN FINANCE PROGRAM
WHY DOES EUGENE HAVE THIS PROGRAM AND WHAT DOES IT DO?
The City Council passed Resolution 4709 in May 2002 because it was concerned about the
escalating costs of running for City office, and the appearance of impropriety when an individual
or corporation contributes significant funds to a candidate's campaign.
The program is entirely voluntary and is designed to encourage candidates for City offices to
limit campaign expenditures and contributions.
WHAT ARE THE LIMITS?
Limits cover a single election only. Consequently, if a candidate has a run-off election, the limits
start over. Participating candidates must pledge to comply with the following:
City Council Candidates
. Total expenditure limit of $7,500
. Contribution limit of $100 per person or entity
· Contribution limit of $500 from a candidate for his/her own campaign
. No contributions after the filing deadline for second supplemental campaign contribution
and expense report.
Mavoral Candidates
. Total expenditure limit of $30,000
. Contribution of $500 per person or entity
. Contribution limit of $500 from a candidate for his/her own campaign
. No contributions after the filing deadline for second supplemental campaign contribution
and expense report.
HOW DO CANDIDATES PARTICIPATE?
Candidates sign a pledge form at the time of filing their preliminary paperwork with the City
Recorder or they may declare their intention to participate not later than 5:00 p.m. on the fifth
working day after the filing deadline for a primary election or the primary ballot certification for
the general election.
A candidate who follows these limits files the required state contribution and expense reports at
the same time and using the same forms as candidates who have not made the pledge.
HOW DO VOTERS KNOW ABOUT CANDIDATES' PARTICIPATION IN THE P,ROGRAM?
Names of all candidates and whether they have pledged to comply with the voluntary limits will
be published on the City of Eugene's website. They will also be published in a local newspaper,
on at least two occasions prior to the election.
The City makes available on the City website or upon request, the second supplemental report
and any reports as required by the State of Oregon.
If the City of Eugene determines that a candidate who pledged to follow the limits has failed to
do so, the City Manager shall provide the public with notice of that failure. Nodee may be
provided on the City's website or through publication in a local newspaper.
