The City Council is asked to adopt the attached ordinance providing for the withdrawal from special service districts of recently annexed territory. BACKGROUND Withdrawals from special districts routinely come before the council on an annual basis. Properties annexed during the previous year are batched together to facilitate this process. The current batch contains 33 annexation requests made by property owners in 2007 for which withdrawals are needed. This action removes these properties from the listed special districts because the City has assumed the responsibility for providing these services following annexation. Withdrawal of properties from rural fire protection districts occurs automatically upon annexation, while a separate process is required by state law for withdrawals from a water supply district, sanitary district, or park and recreation district. Annexation of the subject parcels was initiated by the property owners, in most cases to facilitate development. Inclusion of the subject parcels on City tax rolls, and withdrawal from special district taxation was anticipated by the applicants as part of the annexation process. Public notice of this hearing was published and posted as required by state law. The attached ordinance (Attachment A) describes the affected properties and withdraws them from special districts. On February 25, 2008, the council will be asked to determine whether the withdrawals are or are not in the City’s best interest. If the withdrawals are found to be in the City’s best interest, the ordinance should be adopted to make the withdrawals effective. Withdrawals are time-sensitive. The Oregon Revised Statutes Chapter 222 provides that if the withdrawal is not approved or enacted prior to March 31, 2008, the withdrawal does not become effective until July 1 of the following year. If the withdrawal is not effective by July 1, these properties will remain on the tax roll of the special service districts that no longer provide services to the property. Enacting the withdrawal ordinance prior to March 31, 2008, will result in the withdrawals taking effect L:\CMO\2008 Council Agendas\M080219\S0802194.doc on July 1, 2008. To meet this deadline, action on this ordinance is scheduled for February 25. Legal descriptions and maps showing the location of each annexed property subject to withdrawal are included in the council packet for the public hearing (Exhibits 1 through 33). RELATED CITY POLICIES None. Properties are withdrawn from special districts upon annexation to the City as a result of the City assuming responsibility for providing urban services. COUNCIL OPTIONS The council must conduct the hearing pursuant to state law. The City Council will consider the following options for action on February 25, 2008: 1. Adopt the ordinance as drafted, keeping the withdrawal process on track to meet the March 31 deadline for including the withdrawn properties in the City’s tax rolls for the coming fiscal year. 2. Pass an amended ordinance including some, but not all, of the listed withdrawals. 3. Take no action at this time, thereby leaving all the properties on the tax rolls of the special districts for the coming fiscal year. CITY MANAGER’S RECOMMENDATION This is scheduled for a public hearing only. Following the City’s receipt of all evidence, prior to council deliberations, the City Manager will make a recommendation to be included in the council packet for the February 25, 2008, deliberation. SUGGESTED MOTION No motion is suggested as deliberation and action is currently scheduled for February 25, 2008. ATTACHMENTS A. The City Council of the City of Eugene finds that: A. Notice of the proposed withdrawal of real property contained in the River Road Water District and the River Road Park and Recreation District, and from the Santa Clara Water District (“the Districts”) which have been annexed to the City, was published in the Register-Guard on February 4 and 11, 2008, and posted in four public places in the City of Eugene for the same period of time. B. The Notice provided that a public hearing was set for February 19, 2008, at 7:30 p.m., in the Council Chambers, City Hall, in Eugene, Oregon, for the purpose of hearing objections to the withdrawals. C. The City is willing to assume the liabilities and indebtedness previously contracted by the Districts proportionate to the parts of the Districts that have been annexed to the City upon the effective date of the withdrawals. D. The withdrawals of the annexed territories from the Districts are consistent with adopted City policies, and are in the best interest of the City. NOW, THEREFORE, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1.
