BACKGROUND The City Council held its public hearing on this item on February 19, 2008. The ordinance (Attachment A) specifies 33 territories now annexed to the City of Eugene that are proposed to be withdrawn from the special service districts that previously provided services to these properties. These annexations were initiated by the property owners and approved by the Boundary Commission in 2007. The City Council is asked to adopt this ordinance, which provides for the withdrawal from special service districts of these annexed territories. Oregon statutes provide only one general approval criterion for withdrawals: the City “shall determine whether such withdrawal is for the best interest of the city” (ORS 222.524). If the council finds that the withdrawals are in the City's best interest, the ordinance must be approved by March 31, 2008, or the withdrawals will not become effective until July 2009, and these properties will remain on the tax roll of the special service districts that no longer provide services to the property. The council packet for the February 19, 2008 public hearing contains the ordinance and legal descriptions and maps (1 through 33) showing the location of each annexed property subject to withdrawal. The ordinance and exhibits are provided here again for the City Council's convenience. RELATED CITY POLICIES None. Properties are withdrawn from special districts upon annexation to the City as a result of the City assuming responsibility for providing urban services. COUNCIL OPTIONS The City Council may consider the following options: F:\CMO\2008 Council Agendas\M080225\S0802254.doc 1. Adopt the ordinance as drafted, keeping the withdrawal process on track to meet the March 31 deadline for including the withdrawn properties in the City’s tax rolls for the coming fiscal year; 2. Adopt an amended ordinance including some, but not all of the listed withdrawals; or 3. Take no action at this time, thereby leaving all the properties on the tax rolls of the special districts for the coming fiscal year. CITY MANAGER’S RECOMMENDATION The City Manager recommends adoption of the ordinance as drafted, providing for withdrawal of all of the listed territories by March 31, 2008. SUGGESTED MOTION Move to adopt an ordinance withdrawing territories from the River Road Water District and River Road Park and Recreation District and from the Santa Clara Water District. The City Council of the City of Eugene finds that: A. Notice of the proposed withdrawal of real property contained in the River Road Water District and the River Road Park and Recreation District, and from the Santa Clara Water District (“the Districts”) which have been annexed to the City, was published in the Register-Guard on February 4 and 11, 2008, and posted in four public places in the City of Eugene for the same period of time. B. The Notice provided that a public hearing was set for February 19, 2008, at 7:30 p.m., in the Council Chambers, City Hall, in Eugene, Oregon, for the purpose of hearing objections to the withdrawals. C. The City is willing to assume the liabilities and indebtedness previously contracted by the Districts proportionate to the parts of the Districts that have been annexed to the City upon the effective date of the withdrawals. D. The withdrawals of the annexed territories from the Districts are consistent with adopted City policies, and are in the best interest of the City. NOW, THEREFORE, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The following territory in Lane County, Oregon, annexed to the City of Eugene effective November 8, 2006, by Notice of the Lane County Local Boundary Commission approved on October 23, 2006, is withdrawn from the River Road Water District and River Road Park and Recreation District, effective July 1, 2008: Tax Lots 2200, 2500, and 2501, Assessor's Map 17-04-23-24, located in the River Road region of north Eugene, south of Beltline Road, west of River Road, south and west of Park Avenue, north of Elkay Drive, and northeast of the Northwest Expressway, and more particularly described on the attached Exhibit 1 and incorporated herein by reference.
