PASSED: 8/0 REJECTED: OPPOSED: ABSENT: CONSIDERED: January 24, 2005 RESOLUTION NO. 4822 A RESOLUTION CALLING A PUBLIC HEARING TO CONSIDER PROPOSED WITHDRAWAL OF TERRITORIES FROM THE RIVER ROAD WATER DISTRICT AND RIVER ROAD PARK AND RECREATION DISTRICT, THE SANTA CLARA WATER DISTRICT, AND THE JUNCTION CITY WATER CONTROL DISTRICT. RECITALS: A. The Lane County Local Government Boundary Commission by its Notice dated December 17, 2004, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective November 3, 2004: Tax Lot 2700 and a portion of Tax Lot 5400, Assessor's Map 17- 04-14-23, located in the River Road region of north Eugene, south of Beltline Road, west of River Road, west of Bushnell Lane, north of Maxwell Road, and more particularly described on Exhibit A attached hereto and incorporated herein by reference. (Dodson, EC EU 04-49) That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. B. The Lane County Local Government Boundary Commission by its Notice dated March 17, 2004, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective March 5, 2004: Tax Lots 100, 200 and 300, Assessor's Map 17-04-13-33, located in the River Road region of north Eugene, south of Beltline Road, east of River Road, north of East Maynard Avenue, south of East Howard Avenue, and more particularly described on Exhibit B attached hereto and incorporated herein by reference. (Church of God 7th Day/Lanson St., Formac Ave., Copping St., EC EU 04- 11) That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. Resolution- 1 C. The Lane County Local Government Boundary Commission by its Notice dated July 15, 2004, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective April 2, 2004: Tax Lot 3000, Assessor's Map 17-04-25-21, located in the River Road region of north Eugene, south of Beltline Road, west of River Road, north of Crocker Lane, south of Hansen Lane, and more particularly described on Exhibit C attached hereto and incorporated herein by reference. (Bemey, EC EU 04-17) That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. D. The Lane County Local Government Boundary Commission by its Notice dated July 16, 2004, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective May 19, 2004: Tax Lots 3000 and 3100, Assessor's Map 17-04-24-24, located in the River Road region of north Eugene, south of Beltline Road, east of River Road, south of East Hilliard Lane, north of Oakleigh Lane, including East Hilliard Lane right-of-way, and more particularly described on Exhibit D attached hereto and incorporated herein by reference. (Jaqua/Phaigh/E. Hilliard Ln., EC EU 04-18) That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. E. The Lane County Local Government Boundary Commission by its Notice dated July 19, 2004, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective May 3, 2004: Tax Lot 1100, Assessor's Map 17-04-14-31, located in the River Road region of north Eugene, south of Beltline Road, west of River Road, north of Freemont Avenue, east of Hemlock Street, south of Armstrong Avenue, west of Maywood Street, and more particularly described on Exhibit E attached hereto and incorporated herein by reference. The City desires that the property so annexed be withdrawn from those Resolution - 2 Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. F. The Lane County Local Government Boundary Commission by its Notice dated July 19, 2004, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective May 24, 2004: Tax Lot 1102, Assessor's Map 17-04-13-24, located in the River Road region of north Eugene, south of Beltline Road, east of River Road, north of Owosso Drive and Carolyn Drive, and more particularly described on Exhibit F attached hereto and incorporated herein by reference. (Hill, EC EU 04-24) That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. G. The Lane County Local Government Boundary Commission by its Notice dated July 19, 2004, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective June 1, 2004: Tax Lot 701, Assessor's Map 17-04-13-33, located in the River Road region of north Eugene, south of Beltline Road, east of River Road, south of East Maynard Avenue, north of Hatton Avenue, including a portion of Hanson Lane, and more particularly described on Exhibit G attached hereto and incorporated herein by reference. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. II. The Lane County Local Government Boundary Commission by its Notice dated July 19, 2004, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective July 6, 2004: Tax Lot 3200, Assessor's Map 17-04-25-22, located in the River Road region of north Eugene, south of Beltline Road, west of River Road, northeast of the Northwest Expressway, south of Hansen Lane, and more particularly described on Exhibit H attached hereto and incorporated herein by reference. (Massimi, EC EU 04-31) Resolution - 3 That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. I. The Lane County Local Government Boundary Commission by its Notice dated December 17, 2004, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective August 30, 2004: Tax Lot 1800, Assessor's Map 17-04-14-14, located in the River Road region of north Eugene, south of Beltline Road, west of River Road, north of Kourt Drive, south of Silver Lane, and more particularly described on Exhibit I attached hereto and incorporated herein by reference. (Bidwell, EC EU 04-42) That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. J. The Lane County Local Government Boundary Commission by its Notice dated December 17, 2004, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective November 3, 2004: Tax Lots 1300 and 1301, Assessor's Map 17-04-14-14, located in the River Road region of north Eugene, south of Beltline Road, west of River Road, north of Kourt Drive, south of Silver Lane, and more particularly described on Exhibit J attached hereto and incorporated herein by reference. (Hershberger, EC EU 04-46) That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. K. The Lane County Local Government Boundary Commission is expected to act on and issue a Notice advising that pursuant to ORS 199.466 and ORS 199.519, the following described real property will be annexed to the City of Eugene, with an effective date prior to February 28, 2005: Tax Lot 200, Assessor's Map 17-04-13-24, located in the River Road region of north Eugene, north of Owosso Drive, east of River Road, south of Beltline Road, and more particularly described on Exhibit K attached hereto and incorporated herein by reference. (Robert Plank) Resolution - 4 That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. L. The Lane County Local Government Boundary Commission by its Notice dated January 5, 2005, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective January 18, 2005: Tax Lots 3400, 3403, and 3404, and a portion of Tax Lot 3300, Assessor's Map 17-04-23-24, located in the River Road region of north Eugene, south of Beltline Road, west of River Road, and North Park Avenue, south of Elkay Drive, north of the Northwest Expressway, and more particularly described on Exhibit L attached hereto and incorporated herein by reference. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. M. The Lane County Local Government Boundary Commission by its Final Order No. 1231, approved February 5, 2004, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective May 19, 2004: Tax Lot 500, Assessor's Map 17-04-11-14, located in the Santa Clara region of north Eugene, west of Dalewood Street, north of River Loop #1, and more particularly described on Exhibit M attached hereto and incorporated herein by reference. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. N. The Lane County Local Government Boundary Commission by its Final Order No. 1233, approved February 5, 2004, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective May 19, 2004: Tax Lot 500, Assessor's Map 17-04-02-44, located in the Santa Clara region of north Eugene, west of Scenic Drive, north of Wilkes Drive, east of Castrey Street, and more particularly described on Exhibit N attached hereto and incorporated herein by reference. (Syrios/Greenwood St, C EU 04-08) Resolution- 5 That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. O. The Lane County Local Government Boundary Commission by its Final Order No. 1237, approved April 1, 2004, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective May 17, 2004: Tax Lots 9200 and 9300, Assessor's Map 17-04-11-41, and Tax Lots 200, 300 and 400, Assessor's Map 17-04-11-44, located in the Santa Clara region of north Eugene, east of River Road north of Green Lane, south of Hunsaker Lane, and more particularly described on Exhibit O attached hereto and incorporated herein by reference. (Eugene School District 4J, C EU 04-16) That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. P. The Lane County Local Government Boundary Commission by its Final Order No. 1235, approved April 1, 2004, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective May 17, 2004: Tax Lot 4200, Assessor's Map 17-04-11-13, located in the Santa Clara region of north Eugene, west of River Road, east of Ferndale Road, south of Chapel Drive, and more particularly described on Exhibit P attached hereto and incorporated herein by reference. (Crescent Homes Inc./Femdale Dr, Quiet Ln, C EU 04- 14) That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. Q. The Lane County Local Government Boundary Commission by its Final Order No. 1236, approved June 3, 2004, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective July 19, 2004: A portion of Tax Lot 1100, Assessor's Map 17-04-12-20, located in the Santa Clara region of north Eugene, north of River Loop #1, south terminus of Kendra Street, west of Admiral Street, and more particularly described on Exhibit Q attached hereto and incorporated herein by reference. (City of Eugene, C EU 04-15) Resolution - 6 That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. R. The Lane County Local Government Boundary Commission by its Final Order No. 1242, approved August 5, 2004, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective November 3, 2004: Tax Lot 500, Assessor's Map 17-04-02-34, located in the Santa Clara region of north Eugene, east of River Road, north of Irvington Road, south of Argon Avenue, and more particularly described on Exhibit R attached hereto and incorporated herein by reference. (CLA Properties, C EU 04-37) That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. S. The Lane County Local Government Boundary Commission by its Final Order No. 1245, approved October 7, 2004, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective November 22, 2004: Tax Lot 5500, Assessor's Map 17-04-11-14, located in the Santa Clara region of north Eugene, east side of River Loop #1 between Grizzly Avenue and Dibblee Lane, and more particularly described on Exhibit S attached hereto and incorporated herein by reference. (Guthu, C EU 04-51) That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. T. The Lane County Local Government Boundary Commission by its Final Order No. 1249, approved December 2, 2004, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective January 18, 2005: A portion of Tax Lot 6300, Assessor's Map 17-04-10-12, located in the Santa Clara region of north Eugene, north of Beltline Road, west of River Road, east of Northwest Expressway and Arrowhead Street, south and west of Spearmint Avenue, and more particularly described on Exhibit T attached hereto and incorporated herein by reference. (Shepard, C EU 04-57) Resolution - 7 That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. U. The Lane County Local Government Boundary Commission by its Final Order No. 1232, approved February 5, 2004, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective May 19, 2004: Tax Lots 1400, 1500, 1600 and 1700, Assessor's Map 16-04-35- 30, located in the Santa Clara region of north Eugene, south of Beacon Drive, west of River Road, and more particularly described on Exhibit U attached hereto and incorporated herein by reference. (Weichert/Bair, C EU 04-07) That property is contained in and is a part of the Santa Clara Water District and the Junction City Water Control District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. V. The Lane County Local Government Boundary Commission by its Final Order No. 1244, approved October 7, 2004, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective November 22, 2004: Tax Lot 201, Assessor's Map 17-04-03-11, located in the Santa Clara region of north Eugene, at the comer of Carthage Avenue and Hyacinth Street, and more particularly described on Exhibit V attached hereto and incorporated herein by reference. (McGraw/Hyacinth St., C EU 04-50) That property is contained in and is a part of the Santa Clara Water District and the Junction City Water Control District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a Municipal Corporation of the State of Oregon, as follows: Section 1. The City Council proposes that the territories bounded by the lines running as follows, which have heretofore been annexed to the City of Eugene, shall be withdrawn from the River Road Water District and River Road Parks and Recreation District: Tax Lot 2700 and a portion of Tax Lot 5400, Assessor's Map 17- 04-14-23, located in the River Road region of north Eugene, south Resolution- 8 of Beltline Road, west of River Road, west of Bushnell Lane, north of Maxwell Road, and more particularly described on Exhibit A attached hereto and incorporated herein by reference. Monday, February 28, 2005, at 7:30 p.m., Pacific Time, in the Council Chambers, City Hall, Eugene, Oregon, is hereby fixed as the date, time and place for heating objections to the withdrawals.
