ISSUE STATEMENT
The City Council is being asked to approve the Hearing Official’s Minutes, Findings and
Recommendations dated May 5, 2008, and adopt a resolution forming a Local Improvement District

(LID) for concrete alley paving and constructing wastewater and stormwater systems on 6 Alley
between Tyler Street and Polk Street.
BACKGROUND
The project design and bidding was initiated as a poll petition by the City, in July of 2007. The project
costs appeared to increase as design progressed and a review of support was done in February of 2008.
Property owners who represent 60.8% of the assessable cost within the boundaries of the proposed Local
Improvement District (LID) continued to support the project. The City Engineer initiated the
preparation of plans and specifications, pursuant to Section 7.160(8) of the Eugene Code, 1971, on
March 25, 2008.
Bids were opened on April 10, 2008, with H & J Construction as the apparent low bidder. Property
owners were notified of the pending LID hearing ten (10) days prior to the hearing as required by
Eugene Code. The LID formation hearing was held on April 21, 2008, to review the bid information,
confirm whether the LID should be formed and to identify any special conditions that should be
included in the resolution forming the LID. Two property owners attended the hearing (see Hearings
Official Minutes). No remonstrance has been received.
Financial And/Or Resource Considerations
Based on the low bids received, the costs, listed below are the total estimated assessment costs plus
contingency for the local improvement district. The calculations are consistent with adopted council
policy.

The City cost is primarily for the wastewater system rehabilitation work and improving access to the
stormwater system.
Alley assessments are based on both frontage and area calculations in the following manner:
The front footage of a parcel along the alley and its’ square footage area (within 160 feet of the
improvement frontage) is ascertained and that footage and square footage shall be weighted on the basis
of the parcel’s existing use and zoning. The existing use factor shall be multiplied by the frontage. The
permissible use by zoning factor will be applied to the area. The combination will determine the
assessable portions of the project to each individual parcel. One-half of the general costs and overhead
of the project shall be apportioned on the basis of weighted frontage and one-half on the basis of
weighted area.
Assessments are anticipated to be levied following completion of construction. Following the levy of
assessments, a 10-year payment plan through the City, will be available to all property owners within the
improvement district as identified by Eugene Code, Chapter 7.
This project has no property owners that meet criteria for the Low-to-Moderate Income Street
Improvement Subsidy Program. All properties are commercially zoned. The subsidy program is
available to property owners who occupy a single family dwelling or duplex and meet other program
criteria.
Project
This project is an existing City alley between Polk Street and Tyler Street with gravel surfacing and no
City storm facilities. The gravel surface is in very poor condition despite frequent property owner
grading. The cause of the rapid deterioration of the alley surfacing is a result of level topography and the
lack of a storm system necessary to rid the area of standing water. A current wastewater line is located
within the alley and was originally constructed in 1914. The wastewater pipe is in very poor condition
and was scheduled for the 2008 wastewater rehabilitation program to line or otherwise repair. The
proposed project will replace the wastewater pipe with new pipe, add a storm system including a water
quality structure, and resurface the alley with Portland Cement Concrete bringing it up to City standards
as described in the Eugene Code and the Public Improvement Designs Standards manual.
RELATED CITY POLICIES
The formation of the LID will be consistent with City Council adopted policy.
COUNCIL OPTIONS
Per Section 7.166(3) of the Eugene Code, the City Council can take the following actions:
1.Adopt the resolution forming the LID.
2.Substantially modify the improvements, re-bidding if necessary, and then conduct a hearing on
the modified improvements.
3.Delay the approval not more than 15 days.
4.Abandon the improvements.

CITY MANAGER’S RECOMMENDATION
The City Manager recommends that the council approve the Minutes, Findings and Recommendations
of the Hearings Official and adoption of the resolution forming the LID as described. The bids received
are comparable to projects of similar size and scope and formation of the LID will be consistent with
council-adopted policy.
SUGGESTED MOTION
1.Move to approve the Minutes, Findings and Recommendations of the Hearings Official of May 5,
2008.
2.Move to adopt Resolution 4941 for concrete alley paving, and constructing wastewater and
