HomeMy WebLinkAboutAdmin Order 58-04-21-F ADMINISTRATIVE ORDER NO. 58-04-21-F of the City Manager of the City of Eugene ADOPTION OF STANDARDS FOR TRANSPORTATION DEMAND MANAGEMENT (TDM) PROGRAM ADMINISTRATIVE RULE R-9.8030(10). The City Manager of the City of Eugene finds as follows: A. Section 2.019 of the Eugene Code, 1971 (EC) authorizes the City Manager to adopt rules for administration and implementation of any provisions of that Code, including provisions in EC Chapter 9 that require a developer to provide a certain number of off-street parking spaces, subject to provisions authorizing an adjustment, and the requirement to have a Transportation Demand Management (TDM) Program that has been approved by the City. B. Pursuant to that authority, and based on the findings contained in Administrative Order No. 58-04-21, the City Manager proposed the adoption of Standards for Transportation Demand Management (TDM) Program Administrative Rule R-9.8030(10). C. Notice of the proposed adoption of Transportation Demand Management (TDM) Program Administrative Rule R-9.8030(10) was pubhshed tn the Register Guard, a newspaper of general circulation w~thin the City for at least five consecutive days, to-wit, on December 12, 13, 14, 15 and 16, 2004. The Notice was also posted at C~ty Hall on December 13, 2004, made available to persons who had requested notice, and provided that written comments would be received thereon for a period of 30 days from the first date of publication. Persons could also provide written or oral comment at the public hearing held on January 6, 2005. No comments were received within the time or in the manner required by the Notice and no one testified at the public hearing. Based on the above findings, which are hereby adopted, and the findings in Administrative Order No. 58-04-21, I hereby adopt Standards for Transportation Demand Management (TDM) Program Administrative Rule R-9.8030(10), to provide as follows: STANDARDS FOR TRANSPORTATION DEMAND MANAGEMENT PROGRAM ADMINISTRATIVE RULE R-9.8030(10) R-9.8030(10)-A Purpose. As provided in EC 9.8030(10), the purpose of a Transportation Demand Management (TDM) Program is to provide a mechanism for the applicant seeking an adjustment to the number of off-street parking space provisions of EC 9.6410 to demonstrate that it has a strategy for reducing vehicle use and parking demand generated by the development and that the applicant has established benchmarks by which the program's effectiveness will be measured Administrative Order - 1 J \e mam\00090\l 5 la\00107080 WPD annually. R-9.8030(10)-B Applicability. 1. Reduction of Required Parking Spaces. A request for an adjustment to the required number of off-street parking spaces to allow for a reduction by up to fifty percent must be accompanied by a Transportation Demand Management (TDM) Program that has been approved by the City that contains strategies for reducing vehicle use and parking demand generated by the development and establishes benchmarks by which the program's effectiveness will be measured annually. 2. Increase of Required Parking Spaces. A request for an adjustment to the required number of off-street parking spaces to allow for the installation of up to 150 percent of the minimum spaces must be accompanied by an employee-based TDM Program that has been approved by the City. R-9.8030(10)-C Approval Criteria. The City shall approve a TDM Program if it contains the following information and is submitted on the TDM Program form a copy of which is attached to this Rule as Exhibit A: 1. The appointment of a contact person with whom the City can communicate regarding the performance of the Program and a process for notifying the City of any change of the contact person within 30 days of such change. 2. The requirement that the contact person post all information received from the City regarding alternative transportation modes in a conspicuous location so that the information may be read by all customers, clients, and/or employees during business hours. 3. A method of providing to new employees information and materials provided by the City regarding alternative transportation modes to encourage them to avoid driving alone to the workplace. 4. A method of providing to all employees at least once per year written and oral information regarding alternative transportation modes, and allow the City or its designated representative the opportunity to participate in the presentation(s). 5. A process for the monthly inventorying of the supply of information regarding alternative modes of transportation and the requirement that the contact person will contact the City' s TDM coordinator for replacement information. 6. The selection of at least four TDM measures from the eleven measures set forth in section E of this Rule and an explanation of how the selected TDM measures will be implemented. Administrative Order - 2 J \e_mmn\00090\l 51 a\00107080 WPD 7. A statement that all leaseholders will be bound by the terms of the approved TDM Program. 8. The signature of the person submitting the proposed TDM Program. R-9.8030(10)-D Annual Reports. If an adjustment to the off-street parking space provisions is made to allow a reduction in the number of required parking spaces, an annual report must be submitted to the City by which the TDM Program's effectiveness can be measured. The annual report must by submitted on the Transportation Demand Management Program Annual Report form, a copy of which is attached to th~s Rule as Exhibit B. R-9.8030(10)oE Acceptable TDM Measures. 1. Subsidies for Alternative Commute Modes Users. Subsidies for those traveling by any mode other than a single occupant vehicle, including all forms ofndesharing as well as public transit, bicycling, and walking. 1.1 Provide a form of subsidy to the employee that can include, but is not limited to, cash reimbursement, vacation time, compensatory time, or other non-cash incentives. 1.2 Specify the benefit being offered, and that the benefit shall be offered to all employees who use alternative commute modes. Subsidymust be great enough to effectively reduce reliance on the single occupant vehicle (SOV). 2. Subsidized or Group Transit Pass Program. A program for subsidizing a transit pass for an amount not less than fifty percent of the value of a monthly pass. 2.1 All employees shall have the ability to purchase monthly bus passes either through payroll deductions or over-the-counter sales. Subsidized transit passes shall be provided to all employees at the same percent of subsidy. 2.2 Contact the Lane Transit District and develop a program. 2.3 Post and distribute all materials provided by Lane Transit District. 3. Sponsor Vanpool Program. A program for six or more people commuting to and from work in a vehicle that is subsidized by the employer. 3.1 Purchase, lease, or otherwise subsidize the capital and/or operating cost of one or more vanpools used by the future employees of the development. 3.2 Specify the type and level ofvanpool assistance to be provided throughout the duration of the program, the number of vans to be subsidized, or dollar amount per Administrative Order - 3 J \e ma~n\00090\151a\00107080 WPD passenger, the number of anticipated vanpool participants, and the period of time which the vanpool program will be in effect. If parking fees are imposed, vanpoolers shall receive a minimum discount of fifty percent of the normal parking fees charged for parking at the facility. 3.3 Parking spaces must be reserved for vanpools and must be labeled or marked "Carpool/Vanpool Only." The preferential treatment for these spaces may be the location entrance(s) or exit(s) of the parking lot, near the employee entrance, covered spaces, or something otherwise considered preferential by the employees. The placement of the parking spaces must be designated in the construction plans and approved prior to receiving the Building Permit. 4. Guaranteed Ride Home Program. A program guaranteeing a ride home to an employee who uses a commute alternative other than the single occupant vehicle when a ride home is necessary in case of personal or family illness, overtime, or other emergency. There are several options for providing an employee a guaranteed ride home, including taxis, fleet vehicles, rental cars, vanpools, and carpools. The mode for the ride home is often determined by the length of the ride. 4.1 Specify the benefit being offered and the eligibility criteria. The benefit may be an unlimited number of free rides home, or a limited number of free rides with the employee paying a percentage of the cost of additional fides. 4.2 Elig~bihty may be for all employees who did not commute to work in a single occupant vehicle, or limited to those employees who use a commute alternative at least 2, 3 or 4 days per week. 5. Telecommuting. Work performed at the home or telecommuting center and can include, but is not limited to, the use of telephones, computers, or other similar technology. The work performed would normally be done at the employment worksite, thus eliminating the home to work trip. 5.1 Specify the percentage of full-time employees who will be eligible to telecommute. 5.2 Specify how many days per week eligible employees typically telecommute. 6. Compressed Work Week. A work hour management strategy that allows the employee to schedule the usual number of work hours in fewer workdays per week or pay period. This schedule regularly allows a full-time employee to eliminate at least one workday every two weeks by working longer hours during the remaining days. 6.1 Specify the work week options among which the employees will be able to choose. Administrative Order - 4 J \e_mmn\00090\l 51 a\00107080 WPD 6.2 Specify the percentage of full-time employees who will be able to participate in this program, and the period of time which this program will be in effect. 7. Flextime. A work hour management strategy that allows the employee to adjust work hours outside of the applicant's established start and stop time. Flextime shall be done to better facilitate the use of transit, carpool/ndematch, bicycling, and walking at non-peak hours, or to allow dispersal of arrival and departure times at the business. 7.1 Arrivals and departures can typically vary from a fifteen-minute to two-hour difference from normal shift time or adjacent-street peak traffic periods. 7.2 Specify the percentage of full-time employees who will be eligible to incorporate flextime into their schedule. 8. Ridematching Program. A system used to bring people together in a rideshare arrangement, An effective approach to ridematching is to combine in-house services with those of a regional ridematching/ridesharing agency. In-house ridematching can be performed by matching employees on the basis of their home zip codes and/or work schedules. Company newsletters and ridematching bulletin boards are effective means to facilitate in-house ridematching. 8.1 Either develop a ridematching program in-house with assistance from C~ty or Lane Transit District or join the regional ridematching pool managed by Lane Transit District. 8.2 Post and distribute all materials pertinent to the ridematching program including those provided by Lane Transit District. 9. Charge for Employee Parking. Monthly parking fees imposed for all of the employees of the development whose primary commute method will be the single occupant vehicle. 9.1 A minimum fifty percent discount must be given for carpool/vanpool parking spaces or permits. 9.2 Specify the amount of parking fees to be imposed. These fees must be consistent with nearby parking rates. 10. On-Site Transit Pass Sales. The option for all employees to purchase transit passes on-site. 10.1 Contact Lane Transit District to develop a program. 10.2 Passes and tokens may not be sold for an amount higher than the price established by Lane Transit District. The collection of a commission, handling fee, or any Administrative Order - 5 J \e mam\00090\151a\00107080 WPD other surcharge is prohibited. 10.3 Information about the passes and bus schedules must be made available in a timely manner and must be publicized to employees. 11. Shower and Locker Facilities. Shower and clothes locker facilities for employees to encourage bicycle commuting and walking. 11.1 Facilities must be conveniently located near the bicycle storage facilities. l 1.2 Specify the number, description, and location of the facilities. 11.3 Fees for use of the shower and locker facility may not be imposed on employees who wish to use the facility in conjunction w~th their commute to or from work. 11.4 Showers and lockers must be included in the budding plans in order to receive the Building Permit. 11.5 Showers and lockers for buildings w~th multiple tenants must be available to employees of all tenants. R-9.8030(10)-F Report Certification. The term "traffic engineer" used in EC 9.8030(10)(a) 1 means a Professional Civil or Traffic Engineer currently licensed to practice within the State of Oregon, with special training and experience in transportation engineering and planning.
