<br /> <br />ECC <br />UGENE ITY OUNCIL <br />AIS <br />GENDA TEM UMMARY <br /> <br /> <br /> <br /> <br />Annexation Request for Westfair Associates (A 08-2) <br /> <br /> <br />Meeting Date: July 14, 2008 Agenda Item Number: 2D <br />Department: Planning and Development Staff Contact: Lydia McKinney <br />www.eugene-or.gov Contact Telephone Number: 541/682-5485 <br /> <br /> <br /> <br /> <br />ISSUE STATEMENT <br /> <br />This item is a request for annexation and UGB determination for a parcel located at the south end of Sky <br />Bluff Drive on a portion of Tax Lot 201 of Assessor’s Map 18-04-11-00. The applicant requests <br />annexation of the portion of the tax lot as shown on Attachment A. The Planning Director recommends <br />that the City Council defer action until after the council holds a public hearing for this annexation, <br />pursuant to Eugene Code (EC) 9.7820(1)(d)(2). <br /> <br /> <br />BACKGROUND <br />In December 2007, the City Council adopted an ordinance establishing the procedures for annexation <br />requests. EC 9.7820(1)(d) provides for the council to adopt a resolution approving, modifying and <br />approving, or denying the application for annexation. Alternatively, this section also provides the option <br />for the council to hold a public hearing before consideration of the annexation request. Approval of <br />annexation applications are based on the criteria at EC 9.7825 which require that (1) the land proposed <br />to be annexed is within the City’s Urban Growth Boundary (UGB) and is contiguous to the City limits <br />or separated from City limits only by a right-of-way or water body; (2) the proposed annexation is <br />consistent with the applicable policies in the Metro Plan and in any applicable refinement plans and (3) <br />the proposed annexation will result in a boundary in which the minimal level of key urban facilities and <br />services can be provided in an orderly, efficient, and timely manner. <br /> <br />In this instance, the request also includes a UGB determination as the subject property is bisected by the <br />UGB (see Attachment A). This annexation request would establish the precise alignment of the UGB <br />for the subject property. As provided in the Metro Plan (page II-G-14), the UGB is determined on a <br />case-by-case basis through interpretation of the Metro Plan Boundaries Map. In this case, the UGB line <br />is not tax-lot specific as it is not coterminous with the city limits and does not fall on the outside edge of <br />an existing or planned right-of-way. As such, this UGB determination requires Metro Plan policy <br />consideration of a number of factors, including protection of forest lands, ridgeline (drainage basin), <br />orderly and economic public services, existing development and services (city limits), and meeting <br />housing goals. Further, this annexation application has received considerable attention from the <br />neighborhood due to the fact that the UGB is to be determined through this annexation process.
