HomeMy WebLinkAboutItem 2D: Annexation Request for Westfair Associates ECC UGENE ITY OUNCIL AIS GENDA TEM UMMARY Annexation Request for Westfair Associates (A 08-2) Meeting Date: July 14, 2008 Agenda Item Number: 2D Department: Planning and Development Staff Contact: Lydia McKinney www.eugene-or.gov Contact Telephone Number: 541/682-5485 ISSUE STATEMENT This item is a request for annexation and UGB determination for a parcel located at the south end of Sky Bluff Drive on a portion of Tax Lot 201 of Assessor’s Map 18-04-11-00. The applicant requests annexation of the portion of the tax lot as shown on Attachment A. The Planning Director recommends that the City Council defer action until after the council holds a public hearing for this annexation, pursuant to Eugene Code (EC) 9.7820(1)(d)(2). BACKGROUND In December 2007, the City Council adopted an ordinance establishing the procedures for annexation requests. EC 9.7820(1)(d) provides for the council to adopt a resolution approving, modifying and approving, or denying the application for annexation. Alternatively, this section also provides the option for the council to hold a public hearing before consideration of the annexation request. Approval of annexation applications are based on the criteria at EC 9.7825 which require that (1) the land proposed to be annexed is within the City’s Urban Growth Boundary (UGB) and is contiguous to the City limits or separated from City limits only by a right-of-way or water body; (2) the proposed annexation is consistent with the applicable policies in the Metro Plan and in any applicable refinement plans and (3) the proposed annexation will result in a boundary in which the minimal level of key urban facilities and services can be provided in an orderly, efficient, and timely manner. In this instance, the request also includes a UGB determination as the subject property is bisected by the UGB (see Attachment A). This annexation request would establish the precise alignment of the UGB for the subject property. As provided in the Metro Plan (page II-G-14), the UGB is determined on a case-by-case basis through interpretation of the Metro Plan Boundaries Map. In this case, the UGB line is not tax-lot specific as it is not coterminous with the city limits and does not fall on the outside edge of an existing or planned right-of-way. As such, this UGB determination requires Metro Plan policy consideration of a number of factors, including protection of forest lands, ridgeline (drainage basin), orderly and economic public services, existing development and services (city limits), and meeting housing goals. Further, this annexation application has received considerable attention from the neighborhood due to the fact that the UGB is to be determined through this annexation process. Due to these factors, the Planning Director recommends that a public hearing be held to enable further discussion and review of testimony on this proposal. Staff analysis of the applications and whether they comply with applicable requirements will also be provided in conjunction with the hearing packet. RELATED CITY POLICIES The Metro Plan and the South Hills Study contain the policies that are related to this annexation request. As this item is a request to set the public hearing date only and not to consider the merits of the application, relevant policy analysis will be provided in conjunction with the subsequent hearing packet. COUNCIL OPTIONS The council may consider the following options: 1.Set the requested public hearing date for September 15, 2008. 2.Set a subsequent hearing date. 3.Determine that a public hearing is not necessary and request the Planning Director to bring back a resolution for action. CITY MANAGER’S RECOMMENDATION The City Manager recommends that council set a public hearing date for the requested annexation on September 15, 2008. SUGGESTED MOTION Move to hold a public hearing on September 15, 2008, for consideration of the annexation request (A 08-2) made by Westfair Associates.
