ISSUE STATEMENT
Pursuant to unanimous nomination by the Toxics Board, the council is asked to appoint Stephen
Flanagan to that board.
BACKGROUND
The City Charter, in Section 54, provides that the Toxics Board shall consist of seven members: three
representing manufacturers required to report under the Toxics Right-to-Know Program, three with a
record of advocating for the public’s right to know, and one who must be nominated by at least four of
those six. This final position is Position 7 on the board.
The term of office of the previous holder of Position 7 expired in October 2007. No applications for the
position were received during the City’s normal recruiting process that year, and so the Toxics Board
directed a special recruitment process. Following that process, which included newspaper advertising, a
written application period, and interviews by the board, the board has made a nomination by a 6:0 vote.
RELATED CITY POLICIES
This item relates to Section 54, Article VI (6.1.A) of the Eugene City Charter.
COUNCIL OPTIONS
The council has the option to:
1. Appoint the nominee.
2. Decline to appoint the nominee and require the Toxics Board to continue recruitment and to nominate
another individual.
CITY MANAGER’S RECOMMENDATION
The City Manager recommends Option 1: appoint the nominee.

SUGGESTED MOTION
Move to appoint Stephen Flanagan to Position 7 on the Eugene Toxics Board, to a term expiring on
October 31, 2010.
