HomeMy WebLinkAboutORDINANCE NO. 8636'~ 3 ORDINANCE N0. 8636 An Ordinance initiating the vacation of the following described premises, to-wit: Commencing at the Portheast corner of Lot 1, Block 2, Rugh's Second Addition to the City of Eugene, and thence South along the Vilest side of Ramey Street to the Southeast Corner of Lot 5, said Block, thence East 10 feet, thence North to a point 10 feet East of the place of beginning and thence West to beginning; being the West 10 Peet of Ramey Street fronting on Lots 1, 2, 3, 4, and 5, Block 2, Rugh's Second Addition to Eugene, Lane County, Oregon ~l and calling a hearing and directing that notice be given. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The Common Council of the City of Eugene hereby initiates vacation proceedings on its own authority without petition or consent of the property owners, excepting as provided by statute, of the following described property, to-wit: '~ Section 2. A hearing shall be held upon the proposal to vacate the street ',land alley as herein provided, and said hearing shall be had on the 13th day of May, Ii1940, at the Council Chambers in the City Hall in Eugene, Oregon, at 7:30 o'clock p.m. of said day, at which time all persons will be heard upon objections or j!suggestions with reference to the vacation of said portion of street, and at said '~~time the Council will provide for the vacation of said premises or deny such .vacation, and in case the vacation is made will make provisions for any damages sustained, by local assessment. • h Commencing at the Northeast corner of Lot 1, Block 2, Rugh's Second Addition to the City of Eugene, and thence South Il along the West Side of Ramey Street to the Southeast Corner 1 of Lot 5, said Block, thence East l0 feet, thence North ~~ to a point 10 feet East of the place of beginning and• `~ thence Vest to beginning; being the West 10 feet of Ramey Street fronting on Lots 1, 2, 3, 4, and 5, Block 2, Rugh's Second Addition to Eugene, Lane County, Oregon ~j Section 3. The City Recorder be and he is hereby required to immediately ublish for four consecutive weeks in a newspaper published in Eugene, Lane County,. regon, the newspaper selected by him is hereby designated as the official newspaper f the city for this purpose, notice of the proposed vacation. Such notice shall ive the description of the area to be vacated as herein set out, and state the date hen this ordinance was passed; the name of any petitvners petitioning for said acation; the date when the said petition, together with any objection or remonstrant hick may be made in writing and filed with. the City Recorder prior to the date of aid hearing, will be heard and considered. Section 4. The City Recorder shall forthwith and within five days after the irst publication of said notice, post or cause to be posted at or near each end of aid proposed vacation, a copy of the foregoing notice which shall be headed "Notice f Street Vacation", and which•.notice shall be posted in at least two. conspicuous laces in such proposed vacation of such area. The posting and the first day of publication of such notice shall be not ess than twenty-eight days before the time set for hearing. Section 5. 1Plhereas it has been discovered that Ramey Street as platted was isplaced and the occupancys of the adjoining properties have been established based pon the proper location of Ramey Street, leaving a confusion in descriptions and an ncertainty in possession that must be corrected forthwith, an emergency is hereby ecla red to exist and it is declared to be necessary for the immediate preservation f the peace, health and safety of the city of Eugene that this ordinance take effec mmediately upon its passage by the Common Council and its approval by the Mayor, nil it is so ordered. sed by the Common Council is 8th day of April, 1940 s ty Approved by the Mayor this 10th day of April, 1940 ~s/ Elisha Lame Mayor s
