HomeMy WebLinkAboutORDINANCE NO. 864585 ORDINANCE N0. 8645 i An Ordinance initiating the vacation of the following described premises, to-wit: Indiana Street (26th Ave. E.) from the East margin of Columbia Street to the ti^3est margin of Central Boulevard. and calling a hearing and directing that notice be given. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS; Section 1. The Common Council of the City of Eugene hereby initiates vacation proceedings on its own authority without petition or consent of the property owners, exe.epting as provided by statute, of the following described ~ property, to-wit Indiana Street (26th Avenue East} from the East margin of Columbia Street to the VJest margin of Central Boulevard. II ~~ Section 2. A hearing shall be held upon the proposal to vacate the street IIas herein provided, and said hearing shall be had on the 8th day of July, 1940, {at the Council Chambers in the City Hall in Eugene, Oregon at 7:30 o'clock '1p.m. of said day, at which time all persons will be heard upon objectiorlsor suggestions with reference to the vacation of said portion of street, and at said time the Council will provide for the vacation'of said premises or deny such vacation, and in case tYie vacation is made will make provisions for any damages sustained, by local assessment. Section 3. The City Recorder be and he is hereby required to immediately publish for four consecutive weeks in a newspaper published in Eugene, ~ne County, Oregon, the newspaper selected by him being hereby designated as the official .ewspaper of the city for this purpose, notice of the proposed vacation. Such ,otice shall give the description of the area to be vadated as herein set out, nd state the date when this ordinance was passed; the name of any petitioners etitioning for said vacation; the~date when the said petition, together with any bjection or remonstrances which may be made in writing and filed with the ity Recorder prior to the date of said hearing, will be heard and considered. Section 4. The City Recorder shall forthwith and within five days after he first publication of said notice, post or cause to be posted at or near each nd of said proposed vacation, a copy of the foregoing notice which shall be eaded "Notice of Street Vacation," and which notice shall be posted in at least wo conspicuous places in such proposed vacation of such area. The posting and the first day of publication of such notice shall be not ess than twenty-eight days before the time set for hearing. Section 5. Whereas, Indiana Street, which is an extension of 26th Avenue ast, is an unimproved, dangerous area without any roadway or means of passage hereon and serves no property and constitutes a continued menace to the city by eason of possible injury occurring thereon, and it is necessary and desirable nd in the interest of safety that the same be vacated; an emergency is hereby eclared to exist and it is declared to be necessary for the imediate preservation f the peace, health and safety of the city of Eugene that this ordinance take ffect immediately upon its passage by the Common Council and its approval by the ayor, and it is so ordered. sed by the Common Council 27th day of May, 1940 s/ C.
