HomeMy WebLinkAboutORDINANCE NO. 8647' ORDINANCE N0. 8647 An Ordinance vacating the following described area, to-wit: ~~ The East 13 feet and the S'Uest 13 feet of Emerald Street between 24th and 25th Avenues East in the-City of Eugene, ~ Lane County, Oregon, leaving Emerald Street 40 feet in ~i width. i! ~I Y~REAS, Heretofore and on the 22nd day of April, 1940 the Common ~Couneil of the City of Eugene passed an Ordinance setting a hearing for the 10th day of June, 1940 in the Council Chambers, at which time and place protests and ;~iremonstrances could be heard as to the vacation of the following premises, to-wit: The East 13 feet and the 4`lest 13 feet of Emerald Street between 24th and 25th Avenues East in the City of Eugene, Lane County, Oregon, leaving Emerald Street 40 feet in width. and 1 WHEREAS, A hearing was held pursuant to said Ordinance in the Council ~~IlChambers in the City Hall in the City of Eugene on Monday, the 10th day of June, 11940, at 7:30 o'clock'P.M. and at said time the Council heard all objections, and 1 WHEREAS, all persons owning roperty abutting upon said street pro- posed to be vacated have consented to said vacation and have applied for said ~ivacation, it being the purpose of said vacation to make said street conform to ';the plat of that certain unplatted area-which has been laid out by John P. Harpham !and William H. Ho~.es and filed with the approval of the City Planning Commission j'~,and the Common Council, as filed and dedicated. THE CITY OF EUGENE DOES ORDAIN AS FOLZ04JS: Section 1. The Common Council of the City of Eugene finds that due and legal notice of said hearing was published and posted as required by law; that no valid objection has been made at said hearing, or filed; that the consent of the owners of the abutting property, properly acknov.~ledged, has been filed in said proceeding; and that the public interest will not be prejudiced by the va- cation of said portion of said street. Section 2. That said hearing was held on the 10th day of June, 1940 at 7:30 o'clock r.M. in the Council Chambers of the City Hall in Eugene, Lane County, Oregon, and that all matters necessary to be done have been completed. Section 3. That the following described area, to-~vit: The East 13 feet and the West 13 feet of Emerald Street between 24th and 25th Avenues East in the City of Eugene, Lane County, Oregon, leaving Emerald Street 40 feet in width. Abe and the same is hereby vacated and the area so vacated, being a portion of a street, shall revert to the abutting property pursuant to the statutes of the State of Oregon. Section 4. That there is retained to the City of Eugene the right to. install, maintain and repair any necessary public utilities, and the additional right to enter upon the premises for such purposes. Section 5.
