HomeMy WebLinkAboutORDINANCE NO. 8658~.~i o IMPROVEI~IENT ORDINANCE N0. 8658 A,n Ordinance providing for the construction of a sewer, as follows: Beginning at the main city Sewer at the intersection of 24th Avenue East and Chula Vista Street, and running thence East to a point approximately 20 feet East of the Wiest line of Lot ~1, Block 27, Chula Vista Park 2nd Addition, being a 6 inch main; and also three 4 inch laterals serving the properties herein described located in Lots 1, 2, and 3, Block 27, Chula Vista Park 2nd Addition, all in the City of Eugene, Oregon; and declaring an emergency. THE CITY OF EUGENE DOES ORDAIN AS FOLL04VS: Section 1. The Common Council of the City of Eugene does hereby declare its intention to build and construct a sewer as follows: Beginning at the main City Seder at the intersection of 24th Avenue East and Chula Vista Streets, and running thence East to a point approximately 20 feet East of the Viest line of Lot 1, Block 27, Chula Vista Park 2nd Addition, being a 6 inch main; and also three 4 inch laterals serving the properties herein described located in Lots 1, 2, and 3, Block 27, Chula Vista Park 2nd Addition, all in the City of Eugene, Oregon. Section 2. The said sewer shall be constructed of first class, six inch concrete pipe, and the laterals of four inch concrete pipe, according to the plans and specifications of the City Engineer. Sectior}~3. The City Engineer is hereby directed to survey out the location of said sewer, and prepare plans and specifications and a profile thereof, and file the same with the City Recorder. Section 4. The construction of said sewer shall include alI necessary manholes, wyes and all things necessary and convenient for the complete construatio~ thereof. Section 5. The whole cost of the construction of said sewer shall be borne by and assessed to the lots, parts of lots and acreage property liable there for and benefitted by the construction thereof in propoxrtion to the benefits accruing to each lot, part of lot or acreage property, and the Council does hereby ascertain and determine that the following described property is benefitted by the construction of said sewer and is liable for the cost thereof to the amount to each as shall subsequently be ascertained, to-wit: Investors Syndicate The east 48.5 feet of Lot 1, Block 27, Second Addition to Chula Vista Park Addition. Sun Life Assurance Company Beginning at a point 33.4 feet East of the Southwest corner of Lot 2, Block 27, Second Addition,_to Chula Vista Park, thence East 48.5 feet, thence forth 169.3 feet; thence 6`~est 48.5 Peet, thence South 169.3 feet to the place of beginning, all in Eugene, Lane County, Oregon. Frank Semon: Beginning at a point 50.1 feet East of the Southwest corner of Lot 3, Block 27, Second Addition to Chula Vista Park, Eugene, Lane County, Oregon, running `thence East along the Borth line of James Street, 48.5 feet, thence North 169 feet, thence Vliest 48.5 feet, thence South 169 feet to the place of beginning. Section 6. Upon the completion of the sewer the Common Council shall ascertain the cost thereof and assess that portion thereof Q ainst the lots, parts of lots or acreage property liable therefor or benefi:t~ed thereby in accordance with the provisions of the Charter of the City of Eugene, and when said costs are so assessed, the same shall be entered in the City lien docket and be further enforced as provided by the City Charter. Section 7. The City Recorder be and he is hereby directed to give ten days notice to the property owners by posting in three public places in said city lug:. notices of the declaration of intention by the Common Council. according to the provisions of Sections 9S and 99 of the Charter of the City of Eugene. - Section 8, Vdhereas, the improvement contemplated and provided for by this ordinance is a necessary improvement and the sanitary condition of the Iproperty is bad, the construction of said sewer i.s declared essential to the health hand safety of the residents of said district, and it is therefore declared that an emergency exists, and it is necessary for the preservation of the public peace, ,;health and safety that this ordinance take effect immediately upon its passage ~1by the Common Council and approval by the Mayor.
